From what I understand from reading earlier posts, H4 EAD will be processed once H4 is approved. So the activation date on the H4 doesn't matter. EAD application gets processed once H4 gets approved. Correct me if I am wrong.
I think consulting a lawyer regarding this matter will definitely help. I applied cos to H4 with a later effective date couple of years back. I was on F1 OPT and had to go on H4 for a short time and so applied for H4 with an effective date immediately after when F1 gets invalid. I received approval but was still on F1 OPT. This might be a good option for those who are on H1B currently and want to go on H4 EAD without risk of losing work permit (and losing job) in the interim period while applying for EAD.

I think one can request a later effective date/activation date when applying for H4 visa. Lets say you are applying for H4 status with concurrent EAD application on May 23 and request the H4 activation date to start from oct/nov, since EAD will be about 3 months from the date H4 is approved. That way H4 will be effective after the date you receive ead and there will be no employment gap. I don't know if this can be done or not. If there is any rule saying that H4 cos cannot be applied 3 months in advance (I think one can apply for H4 6 months in advance), then all the above mentioned suggestion will be useless.

I am a little worried about this today's news "A federal judge in Texas has temporarily blocked President Barack Obama's executive action on immigration". I know the H4 EAd has been ongoing even before the EO, but they were added in to the EO. Will the final step in H4 EAD gets delayed because of this?
There was a petition in change.org from Shah Peerally and they had an update yesterday saying that it will be effective in next couple of weeks (I know we all know that it will be in next couple of weeks. Just an information)

I really hope the temporary blocking of EO will not effect the H4 EAD

I don't think we can relax until we see the rule published. We can't keep quiet. We should let them know that we need the rule ASAP. I don't think the rule will be effective earlier than 30 days. So around March 1st week at the earliest. And it will take another 2 months for us to receive EAD. Around mid May we may be receiving EAD and will be able to work. So, still long way to go.

If USCIS starts processing applications for illegals, then even if the H4 EAD rule is passed, will it take several months to actually receive H4 EAD and will it delay any other H1B related processing times due to increased work load? I hope not.

I was thinking the same thing. If they cannot get this rule, then we should raise funds and go legal way since we are legals and no one is caring about legals. I will be happy to donate for that cause.

Why will Leon Rodriguez say it will happen soon if they have no plans to publish the rule? It will happen soon. But my point is, if they keep delaying, then the EAD for those who cleared I-140 (immigration reform) will be effective earlier than this rule and this rule will be less useful for families as most will opt for the other one.

I agree. Illegals who came in 2010 will be getting EAD soon, while H4's who came here long before that don't get anything yet. so unfair. I know there is political benefit for helping illegals and not H4 EAD's
I am still having hopes that the H4 EAD rule will pass soon. It will happen before the H1B season this year. USCIS knows that many H4 people are waiting to apply for H1B and so many H1B's will be taken by H4 people and if they pass the rule before the H1B season, there will be less number of applicants in the H1B pool this year. They have all metrics of how many change of status from H4-H1B.
In 2008, they enabled the option of OPT extension immediately after the H1B cap reached, when many US graduates couldnot get in the H1B lottery for advanced degree. I am a little positive it will happen soon in Feb.
