Topic: Urgent Help Needed!!!!!! IO with State Police at home today morning.

Just stay calm, you are just fine, there is nothing wrong with you, as long your I-485 is pending, and you have a valid EAD with you. Please carry the following documents with you to the judge.

1. your passport
2. your current EAD
3. All your past H1B approval/s
4. I-485 receipt
5. I-140 approval notice (if possible)

No they cannot deport you, as you are in here legally, and you are just going to be an LPR shortly.

If the judge passes any incorrect judgement, please get a lawyer with you, to counter the judgement.

Hi itsmygc - This is what LUDs i got on mine:

my AP was applied on the 1st of Oct 2008, they did send me the receipt hence got an update on the 4th of this month ( for all my application) myself, wife and son.

I did get another LUD on the 9th of Oct 2008, but no change in status

LUD on the 12th of Oct 2008 in the late evening, and all the 3 applications were approved.

My RD was 31st July 2007, hence USCIS might be working on the cases filled in the 1st week of August 2007.

I would suggest, that you take a info pass and get an appointment, and just go there, and get your EAD ASAP, you will not be able to work without this card.

Nothing to worry, you might be approved by now. The system in USCIS is slow, hence you see any delay in update.

probably it got approved, and it is taking time to update on the system. There will be no email notification, hence you are not going to get any emails from USCIS. My case was approved on the 9th of Oct, but the update on the system did happen on the 12th late evening.

they should not deny your application, they should ask for AC21, they are not following the rules. You are fine do not worry, you can get this done thru and MTR.

Yes you can get this in India, in designated hospitals in india, i beleive she needs to go to the Appollo hospital to get this done. And I beleive it is listed in the list of places where you can get this done.

probably yes, I got my approval on a sunday (10/12/2008), Yes I am still awake and calling all my families back home. And you might get it approved tomorrow. they are processing 1st week of August 2007.

All - this had been a great time for me and my family. Myself, wife and son all got the approval on-line. There was no email notification for the last 1 week.

Here are my stats

labor : Sept 2002

Labor approval : 31st May 2007 (No RFE)

I-140 : application 07/03/2007 - approval 01/2008 ( no RFE)

I-485 : applied July 31th 2007- approval on the 9th of Oct 2008.(No RFE)

Category : EB2

Country : India

Time from the date of Labor : 6 YEARS 20 days ...

Here are my advice to all fellow teammates :

1. Please stay put, do not worry it is going to come (look it took over 6 years for me)

2. Concentrate on your work , try to be as productive as possible. Never Give up, I did not give up, i am holding on to my Jobs for the last 9 years now. (had gone thru so many layoffs, team allignment etc...but I made it thru)

3. Save as much you can, spent what you can after the GC, ( I got my home, car and all the stuff is needed in the home) this year, I am happy I did all this in Mar-April 2008, 6 months ago, now I am reaping the benefit.

4. Spent more time with your family. Please share your thoughts etc with your wife, try to sync with all the info. Yes my wife started working last november, and see it made life lot easier for us today.

5. stay focussed with your skills and knowledge. This is very important, GC stress might impact this, but never allow your deligence to move away.

Yes here is my story, I have a son who is in the 9th grade, hence it is important that we stay here, rather than going back to india, it is not a viable option.

My daughter is younger, and she is a US citizen hence we had no problem with her so far in US or in india.

Yes we did go down to india every year, this was my 10th year on H1B visa, Yes I did goodbye to my H1B visa.

Again as I said, you all are going to get it, (never worry of an RFE, it is just a process, never allow stress to kill you), Below are the list of RFEs

1. medical TB test (majority of the time) no worries, the doctor made some mistake, you just go to that doctor and get this done one more time)

2. Marriage certificate ( keep some pictures and get a good copy of the court document if you have one)

3. I-94s and I-797 approvals, please keep them save (scan and email them to yourself), keep these in your safety deposit box. >>> this is very important, and USCIS is a stupid organization they might ask, keep your old passport also with you.

4. Pay stub, even you have online-stub, please print a copy every pay period, and try to maintain a file at home.

5. Birth certificate : try to get one from the municipality in india, if not possible, try to get from your parents(affidavits), if not possible, try to get an affidavit from one of your relative.

If you have these covered, you just relax, your are going to get this in the next few weeks. Please keep in mind, they are not going to process any N400 applications now, so your I485 is their priority, hence you will be approved.

why alone a house, i bought a house last month(custom built), got all the furniture, bought a new car this year, got all the gardening tools I need, got all the furnishing and decoration for the new home. So it did contribute to the economy a big big way, but my status is still pending. after 6 years of wait for my GC. I am stuck with this PD or Porcessing dates. I did not wait for the 485 to clear, just went ahead and bought it.

Have fun, do not allow GC to come between you and fun time.

Yes I did apply for my spouse on the 1st of August 2008 (EAD renewal), and it got approved for 2 years on the 19th and we got the physical card on the 27th of August 2008.

Yes mine is pending too almost 6 years

my PD is Sept 2002, and I am still waiting.

I-140 = filed 3rd July 2007 approval 28th Jan 2008

I-485 = filed 31st July 2007, still pending (FP notice just came in on the 11th of this month)

I am EB2 and from India, I am not sure what should i be doing. I see people getting GC who filed for labor in 2006, and I am still waiting, and I work for a fortune 10 telecom company. and I am going to complete my 10 years in Feb 2009, I will be starting my 11th year next feb.

Thanks to those smart people in USCIS.

This is what I intend to do " I will meeting Lou Dobb and would be hosting a 1:1 with him, and I would like to highlight the pain and suffering of the EB category folks, and I am going to make sure he does not ever bullsh** any more"
