Topic: Eliminating per-country quota/statement by Rep.Lofgren

immigrant organizations should forcefully oppose removing this cap on per-country limits. this provision is not discrimination but is a preventive measure in having employment based immigration from being monopolized by 2, or 3, or 4, or 5 nations. such countries do not have the monopoly of talent, but the sheer size of their populations would threaten to overwhelm the system if such per-country caps are to be removed at the expense of immigrants who come from smaller populations.
this is not about talent too. this is about spreading the pie to everyone who wants to have a piece of the american dream.

thank you all. i'm not really stressed yet. i'm only on my 4th year on H1b and i have a stamped passport so i can travel. i'm really just curious and a little bit excited by the rapid movement of the philippines' PD. i hope gus21 is right that i'll get the precious GC this fiscal year. i know that other people have waited far longer, so i guess i'm very lucky if this happens. i'm not holding my breath though until i finally see my PD as current. i don't forsee any problems with either my I'140 and I-485 if my assessment is correct. my current H1b is a clean one, meaning no transfers, no gaps in employment, and i feel confidence with my company's immigration law firm, fragomen. if that makes any difference.
i hope the best for everyone especially you alvin since we are in a similar state. i feel fortunate to have found this forum.

i'm not sure if this question has been discussed expensively or if at all in this forum. but i'd like to know from the experts here on what is the likely projection for those cases that were filed during the rush of july/aug 2007. i've seen a rapid progression of the PD for the philippines (my country of chargeability) for about 4 months now. considering the data i am providing below, can someone help me get an idea of what to expect in the next few months, or even years?

I-140 filed 6/12/2007, still pending according to my lawyer
I-485 received 8/3/2007
ND: 9/29/2007
EAD: approved in oct 2007
AP: approved in oct 2007

going by the rate the PD for my country is moving during the past 4 months but considering the heavy volume of cases filed in july/aug, what is the likely scenario? thank you very much.

ginetto is right on the money. the per country cap is not a discriminatory provision of law against countries with high numbers of applicants in both the employment-based and family-based categories like india, china, mexico and previously the philippines (before the rapid movement in its PD), but it protects nationals from countries with less applicants from being drowned out by the competition. the reason the PDs of countries like china, india and mexico have such retrogressed PDs is precisely because such countries have had so much successful approved applications in the past. this provision serves as a check in the country's pattern of immigration from being monopolized by nationals with sheer populations, hence proportionally large applications for US immigration. it is a sort of floodgate against a deluge from immigrants coming from one or two or three countries at the detriment of others.
in other words, the cap helps ensure that diversity is assured with opportunities available for everybody else.
