A friend's aunt filed AOS last year and now the case is transferred to National Benefits Center. Not sure if yours is like that too. There are tons of info on background check in this forum though, why don't you go to infopass, maybe that is one way to find out. Or try senator's office? I am not sure if the 180 days memo thing applies to your case, that could help. Good luck. |

I guess I should have said that assuming your sponsor will not revoke 140 and will provide whatever paperwork you need to show CIS in my questions 2 and 3 (like if you have a good uncle to be the CEO of that company, but he just doesn't want you to work there anymore for some reason). Anyways, I just feel even if you lose your job, but as long as you cut a deal with your employer so that they don't revoke your 140, you should be fine for a while. The sky won't fall immediately as some people think it will, if you have a good relationship with the company that is.
Another point I want to make is that it is really new knowledge for me that you actually don't have to work for the sponsor company after you get your greencard. I guess the 180 days thing is just some precaution and debatable theory too huh ??
BTW, I checked your priority date and it seems that you need to wait another year (hopefully) to become current. Well, best wishes for your case. Obviously, you have contributed a lot to this forum and just want to show my respect and good luck...

1. If the answer to both of my questions is yes, then at least in theory that this is possible: you can get your green card without having to work for that company ever, as long as they sponsor you and you don't care about getting your citizenship later on. Is that right?
I have reading some other threads on AC21, and two more things I don't understand:
2. People are debating whether to use AC21 or not after they switch jobs. My question is this: If you are supposed to work for your sponsoring company after at least 180 days right after you get your green card. Shouldn't you use AC21 to switch your sponsoring company to comply with that requirement? Otherwise what do you do? Go back to the original company and work there for half a year and then switch again?
3. People seems to worry about their status after they are laid off, even though their 485 has been pending for 180 days and they have their EADs. Is that really necessary? Pending 485 itself guarantees your legal status, isn't that right? As a matter of fact, theoretically CIS might as well approve your case and issue you that card without even knowing you are laid off, is that right?
I am new to this AC21 I guess, and hope some one can help me clarify my doubts. Thanks! |

Hi Gurus,
1. Somebody has asked this question before in this thread, but no one answers it.
For a case with approved 140 and pending 485 (more than 180 days) but based on FUTURE EMPLOYMENT, can one use AC21?
My guess answer is yes, but still want to hear somebody to confirm that. Thanks in advance cause this is very important to me.
2. Once 485 is approved, one is supposed to work for the sponsoring company for at least six months (some say two years), my question on that is: What if you don't? How does USCIS know you work for that company or not? Do they check on you at all if you don't file for naturalization after 5 years?

I didn't have a full time job then when I submitted my application.
At least you got an interview, I didn't. I don't have a cluse about how points I got either. It has been two and half years since my MED. I emailed them a few times and they didn't explicitly tell me it is because of the background check, they just tell me they are waiting for other government agencies, whatever that means! Anyways, good luck for your case. |
