I'm in the 4th year of my H1B, I have I-140 approved from my previous employer with PD 6/2012 (I have the copy of I-140 approval notice). I changed my job 1.5 years ago and my PERM with current employer is still Pending. Any idea?

58,530 Applications remaining as of 3/31/2014


That is slightly down from the figures Oh published on Jan 16, 2014 for pending volumes as of 12/12/2013 of 60,037 but it still is a huge number compared to the last time the Factsheet mentioned the figures as of December 31, 2012:


29,344 Applications as of 12/31/2012


The only good news is that the applications received in Q2 FY2014 is well down at 15,474 (compared to around 18k a quarter for the previous 8 quarters).

Also, as we already knew form the LCR, DOL certified 17,192 cases in Q2. In total, DOL processed 19,670 cases in the same period. The Withdrawn and Denial % was 12.6% - lower than the normal 18-20%.



Thanks for the Q2 updates. It seems the lag betwen PWD and PERM may be 4-5 months instead of a quarter. The # of withdrawn cases remain - about 900 cases, which makes sense, as it has nothing to do with DOL - people change jobs as time goes by. Another bad news is FY 2014 Q2 27,801 PERM PWD was determined, therefore, the # of PERM cases will be back to high in FY 2014 Q3, even in the future.

One question: for the 58,530 pending cases, how many of them are audit cases? With so many cases remaining, even DOL keeps current speed, the waiting time seems will not get reduced, if not increasing. If DOL is satisfied with current processing time, then we are in big trouble.

So the number shown on dolstats.com only contains certified cases? If that's the case, then 1500/week is pretty good if number of PERMs get filed gets reduced in the following quarters.

I still have one thing don't understand. If they make 1500/week, it's 18k per quarter, and DOL is still processing FY 2013 Q4, which has ~18k PERM filed, how can they achieve the speed in the past two months? The waiting time shouldn't change if that's the case. May be:

1) They process more than 1,500 cases per week
2) They sent a big portion of cases for audit (sacrifice audit line to move regular line forward?)
3) Many cases get withdrawn

Any other thoughts?

I double check the topic of PWD and found current PWD processing time is around 2 months, which started FY 2014 Q1, so I'm thinking at least we should see the reduction of number of PERMs get filed in FY 2014.

Thanks mannyb. I looked into the data you pointed and here are my summary and prediction:

The analysis is based on the assumption that PERM get filed ~3 months after PWD was determined. So as you pointed out, the PERM received current quarter will be about 62% - 79% of PWD Determined from prior quarter. Therefore PERM cases in FY 2014 Q2 should be between 11,500 and 14,500, if we take the median, should be around 13,000 which is about ~30% less, which is encouraging to me if DOL can make ~2000 cases/week.

If most people start recruitment after PWD gets approved, it seems the delay/reduction in PWD determination reduces the number of PERM get filed annually. I suspect that could be one way DOL takes to relieve their workload.

Where did you get the number 18,473?

In Q1 FY 2014, 23,585 PERM PWD was received and only reduced by 8% compared to Q1 FY 2013;
In Q1 FY 2014, 17,623 PERM cases was received and increased by 3% compared to Q1 FY 2013;

I don't think the total number of PERM cases getting filed will be less in FY 2014
