Has anyone left, used AP to enter the country, left again and used AP a second time?

Did you surrender your I-94 when you left after using your AP or did you keep it? If you kept it, did you encounter any difficulties when you returned on AP the second time?

Topic: Travel on Advance Parole - 2 DUI Convictions

Do not listen to this advice. Consult an attorney regarding your situation. Even with an AP document, you can still be refused entry. They don't do background checks when they issue an AP; you just have to satisfy the criteria set forth in the Immigration statutes and regulations. I received my AP before I was even fingerprinted.

Topic: I-140 RFE -- Experience Letters and Labor Certification

My question is this, and I can't seem to find a clear answer anywhere:

Let's say that you start working for Employer 'X' and a few months later, they ask you if you're willing to stay permanently and that they will file a petition for your GC. When they file your labor certification, you have worked with them for six months or so. If the PERM labor certification is approved and requires 6 months of experience for the position, is it okay to submit an experience letter from your current employer stating that you have been working for them for the six months prior to the filing of the PERM, or do you need to submit an experience letter from a previous employer showing that you have six months experience in the job?

Topic: Suing USCIS? Think Again

Here is a direct quote from the

"These are cases that are languishing, sometimes for years, due to delays in FBI name checks or other background checks. (Such cases should not be confused with those that cannot be approved due to the unavailability of immigrant visa numbers.)"

Congress has been given wide discretion over immigration policy and legislation. Suing the USCIS on grounds of discrimination would be a pointless waste of energy. If you're stuck in namecheck, that's an entirely different story, as the article seems to indicate above.

Topic: it is not easy to change a job after I-485 pending 180 days

Not hiring someone based on immigration status is a big deal and completely and totally illegal. Potential employers are not supposed to ask any questions about immigration status until you are required to fill out the I-9 (i.e at the time of hire). If you are authorized to work in the United States, a company cannot refuse to hire you except in a very narrow set of circumstances (e.g. companies that deal with national security issues may hire only U.S. citizens, etc.). If they are not going to hire you anyway, you might be able to convince a labor attorney to file a lawsuit against them. This kind of invidious discrimination has no place in America. Nail the jerks, is what I say!

Topic: Is there any I-485 case which was denied because of a negative FBI name check?

Because no IO wants to be fingered as the person who let a terrorist or criminal become a permanent resident, especially if it results in death or destruction. Namecheck is designed to discourage those who would fail it from applying in the first place.
