Amanam1,

I was really shocked to hear the news of your denial when you called me last December. You did make fundamental mistakes with your two previous applications. The ECOs apply the regulations to the letter, they show no mercy. Your first application was particularly unfortunate as your maintenace fund was just short of about two weeks. The UK solicitors that advised you must be quakes. Any lawyer, Nigeria or UK based, versed in British immigration should not have advised you the way they did. Please ask us questions on this forum before you make your third application. No mistakes this time. If applications get too frequent it may be detrimental to your new application as ECOs are allowed to have recourse to previous immigration history in taking their decisions. We will pray with you, have faith that things will pull through this time. It is unfortunate that we are yet to hear the success of other people on this forum. Please people share your experience good or bad. It will really help others. I still insist the best way to know about EC applications is by learning from other peoples' mistakes. Even we lawyers do that all the time. I wish you the very best Amanam1.

I prefer to make my advice to you open on trackitt so that other Nigerians can learn from it. I believe that the website you said is bad is that of the VAC (VFS Global). I believe this is the website you are referring to-- https://www.vfs.org.in/ApplicantStatus.aspx You are right, I tried the website but it came up with this:

Hello Amanam1,

I really don't understand the ECO's comment in relation to your claims that you were awarded 75 points for attributes. I would have been in a better position to comment on the ECO's comment if I had seen the Refusal Letter. But since I have not seen the refusal letter I am not able to answer your question properly. However, be optimistic; if you have sorted out the reason for your initial denial in the re-application then you should ORDINARILY be fine.

Hello Cityman77,

Sorry for taking this long to reply you. I have been quite busy relocating to the UK. Whether you maintain £1600 for your wife depends on whether you have the £1600 extra in your account for her EC. If you do not have the £1600 extra then I suggest you just do yours and do hers later. However if you have maintenance fund for her you can just apply for her together with yours. It is the amount of money that you have that will determine whether you can apply for your dependants when making your own application. I hope I have been able to answer your question.

Hello everyone,

It is good to see that a lot of Nigerians have joined this discussion forum from the time I started the discussion. I arrived in the UK last sunday 30/11/08. My port of entry was Heathrow Terminal 3, I came in through Virgin Atlantic. Entry into the UK was straightforward. Upon the checking of my passport by the Immigration officer I was asked to go for a medical right at the airport. This was just an chest x-ray. Nigeria is one of the countries whose citizens who will be staying in the UK for more than 6 months have to do a chest x-ray. Although some people who came in on HSMP told me that they were not asked to do the x-ray at the airport but where told to do it at an NHS hospital near them. Anyway, everyone should be prepared to do the X-ray. I also found out at the airport that they collect chest x-rays if you have already done them from home. I was asked if I brought any. The people that brought theirs did not have to do it, it was just collected and their documentation certified and off they went.

I am quite surprised that processing times back in Nigeria is taking longer than advised by the VAC. I am also surprised that I am still the only one so far on this discussion forum that has gotten EC from Nigeria. My application only took 10 working days as advised, although my application was pretty much straight forward, since I already had an HSMP approval letter and all documents were intact; being a lawyer, I ensured all my documents were in order and did not give the ECO the opportunity to find faults in my application; although GOD was the most instrumental in the success of my EC application. I have come to realize from my experience on this site and from my clients that a lot of people make too far silly mistakes. It is so regrettable to see people with HSMP approval letters being denied EC for just simple errors and mistakes. Just follow the rules and guidelines to the letter and you will be home and dry. If you are in doubt ask people with expertise rather than following your instict. I am still open to advising people and I apologise to those who have directed questions at me. I will answer them soon. I have been quite busy ever since I arrived, settling down and looking for work. I do not have much problem settling down since I had lived in the UK for four and the half years as a student (2001-2005). So I already had UK bank accounts, National Issurance number and an NHS card. I wish everyone success, It will be nice to see the success of everyone's application. God help us all.

I am sorry to hear that your initial application was denied on Maintenance fund ground. You were so close to being granted Tier 1 EC. Now that you have re-applied and you have sorted out the maintenance fund issue you should ORDINARILY be granted Tier 1 EC. I hope all other things are in order, particularly the update of your supporting documents e.g proof of past earnings etc. Let us be hopeful that you will be granted this time around. As long as you have fulfilled the requirement as published in the guidelines all is well. Have faith friend.

Hello Diplomat,

Since you have an HSMP approval letter your requirement is straight forward. All you need to do is meet the maintenance fund requirement, visit the BIA website for further details -http://www.bia.homeoffice.gov.uk/workingintheuk/tier1/general/eligibility/pointsassessment/maintenance/

Now, apart from the bank statement which you must compulsorily include to prove your maintenance fund, there is no other specific document which you must include with your application. HOWEVER, I advise my clients to make their application fault-proof. What do I mean by this? You should provide documents that will tie the hands of the ECO; that is he will have no choice other than to grant you EC; having fulfilled all the requirements. Now, circumstances of people differ. However, these are the basics:

--If you are working; provide evidence of your work(e.g letter from your employer and payslips)
--If you are self-employed; provider evidence of this.
--If you are unemployed provide evidence of your last job(e.g letter from previous employer past payslip)
--If it is obvious that your employment could not have been the source of your maintenance fund. Provide evidence of sale of assets(I believe you know what I mean, we can talk privately on how to do this if you dont know how) or the legitimate source of the money.

Basically you need to provide overwhelming RELEVANT documents to convince the ECO on the balance of probability that the money in your maintenance fund belongs to you and also show the source of the fund through evidence of employment or other means. The above basic proof will help to convince the ECO that the money in your maintenance fund belongs to you and you did not borrow it. Even if you did borrow it, you should not make that obvious ofcourse. Please, also make sure you run your account, don't just dump 2800 pounds in your account for three months and not run the account and expect to be granted EC. There should be regular deposit and withdrawal of funds without the balance falling below 2800 pounds.

Like I said earlier on individual circumstances differ, the additional documentation you include will depend on your individual circumstance. I have given you the baiscs though. Feel free to contact me for further free advice on this forum.
