I need to file for an H1 extension, my 8th year on H1. I have couple of questions:

I have almost 6 months remaining on current H1

a) Should I file for extension thru Premium processing or should I file it under Normal processing
b) How happens if the extension gets denied , does it mean that I cannot reside in U.S after the expiration of my current H1 (Which is valid till June 2018).

I have to for an extension now and was planning to go thru premium processing , not sure if this is the best time to go for. My current H1 expires in April.

I work full time for a billion $$ company and currently in my 9th year on H1.

@Yaaro , thanks for the reply . Another question that I have is , since I do not have a valid U.S Visa will it be a challenge in getting a Canadian Visa ? I visited Canada few years though that visa has expired now.

I have more than 14 years of experience and been working in U.S for last 9 years for an U.S based company. I am about to Join another U.S based fortune 500 company as a Sr.Manager and was wondering if I can file for G.C under EB1 category. The reason for asking this question is because I have never worked as a Manager in India.

All,

My wife needs to renew her visa and she is right now in India. The current U.S Visa on her passport expired in Sep 2016 and this was from my previous employer.I was wondering if she needs to go for consular interview for her new visa or can she go for Drop box as the category of her visa has not changed and it is just a change of employer now. She has EAD right and does it make any difference ?

Hi,

Looks like some progress with the I-140 EAD. I have a approved I-140 from my previous employer and now have changed jobs , would I still be eligible ? If I remember correctly the initial rule is to prevent employees from filing the petition from scratch if they change jobs ...

Need some clarity on this .
