Topic: RFE question?

It should not be a problem as long as you are already met the proferred wages.
One of the USCIS memo states that A2P can be met in 3 ways:
a) Net income should be greater than or equal to proferred wage
b) Net current assets should be greater than or equal to proferred wage. Dont not combine a & b to meet the proferred wage. One of the cases got rejects in appeals with combined a&b
c) Employee should be currently working and paid proferred wage.

I guess you already met condition c and it should not be a problem.
What did your attorney said..?

That is the date when they generated the notice. So that will be notice date.
The receipt date is the date when they received your application in to their mail room.
This came in to picuture because of the July 2007 fiasco.

Applied I-140 during 2007 July fiasco with May 2007 as Priority date. Submitted Tax extension for 2006 along with W2 for 2006 with original application.
Recently got an RFE asking to submit 2006 tax returns and W2's for 2007.
The company is in loss during 2006 and prevailing wage is nearly 9 K less than the paid wage.

What kind of documents will proove the case other than the net assets..
Any ideas and suggestions.. greatly appreciated.

I got RFE on my I-140 asking to submit 2006 tax returns and w2 for 2007. My priority date is in May 2007.
When we submit I-140. in Aug 2007 we submited 2006 tax extension.
Now we got 2006 taxes with huge loses and prevailing wage is nearly 9 K less than the paid wage.

Do you have any idea how to proceed with this.
