This means that Matter of G- Inc., Adopted Decision 2017-05 (AAO Nov. 8, 2017) is binding and precedent decision when it comes to the threshold requirements for a functional manager. This AAO decision, Matter of G- Inc., clarifies that, to establish that a beneficiary will be employed in a managerial capacity as a "function manager," the petitioner must demonstrate that: (1) the function is a clearly defined activity; (2) the function is "essential," i.e., core to the organization; (3) the beneficiary will primarily manage, as opposed to perform, the function; (4) the beneficiary will act at a senior level within the organizational hierarchy or with respect to the function managed; and (5) the beneficiary will exercise discretion over the function's day-to-day operations. Read the USCIS Policy Memorandum.

Certain stakeholder agencies, such as USCIS, USICE, and USDOL, promptly released its plan for implementation of the President's immigration executive actions. However, the U.S. Department of State has yet to release its plan for implementation of the President's order to reform Visa Bulletin management towards the achievement of appropriate allocation of visa numbers timely and efficiently for employment/business enhancement. We understand that the U.S. Department of State has been working with other government stakeholders including the USCIS, but consumers remain in the dark as to whether or not, it is indeed working on it and more importantly the outline of plan. We urge the U.S. Department of State to release some guidance for visa consumers on its plan for implementation of the President's immigration executive action.

No chance for PD becoming current unless recapture or dependent exemption current. Just because they made current on 2007(by mistake or goof up) they will not do that goof up. Law does not allow that. But if recapture comes all the PDs will become current with 3 months. Did IV made the statement that PD will become current just like that? I do not think so. My guess would be recapture comes then everything will be current. May be that is what IV is saying

Folks :

I really feel the same way as most of you do, at this point atleast it's hard to believe that I-140/EAD is going to happen. But, if on Apr 17th the injunction is lifted on DACA/DAPA, and they start implementing those actions then we can put collective pressure on the administration to act on I-140/EAD immediately.



There was an indication from the statements that Companies invested on employees on h1 that there will be delay and or dilution in EAD for I140.

I think EAD for I-140 approved is a done deal,IF the they are going to give EAD for undocumented parents,whose kids were US citizens,they shall give EAD to all I-140 approved also.
Other wise it will create a plethora of legal issues for the administration.
Take my case,I have a son, 6 years old,US citizen.I have been living here since 2007,legally.
If I apply for EAD under the above category,I shall be eligible.But,as I am not undocumented they may reject my case.
In this scenario, I may not be able to challenge the decision,but my son can and he will have a legal standing as he is a US citizen and he is impacted by that decision.
Just my 2 cents.



Excellent point, My situation is similar to yours and there should be thousands like us, we can also send this line of argument to USCIS along with other comments. All govt agencies try to avoid legit lawsuits as much as possible.

Actually there is a possibility that some courts may give judgment that some or all of immigration EO can be unconstitutional. But all will end up with US Supreme court. It may take 1 to 2 years to complete the lawsuit. It will be interesting and create a precedent for future EO limits
