Topic: H4 EAD while changing employer

I already received H4 EAD for my wife till 8/2017 based on H4 Validity date and approved I140 from my current employer.
I am planning to change my employer. My new company will file for H1 and H4 Extension for 3 years based on my approved I-140 from my previous employer.

Can I file for H4 EAD while applying for H1/H4 Extension with new employer?
I have read on USCIS website that H4 EAD Renewal can only be submitted 120 days before expiry date.

My concern is that the previous employer might revoke I-140 when I leave. If I do not have I-140 approved with the new employer before her EAD expires, then she might not be able to renew at that time and hence I wanted to ensure she gets 3 years of EAD when I change employer.

I have a question related to H4 EAD while changing employer
I am on H1 and my spouse is on H4 (along with EAD). My H1 and her H4 EAD are valid till Aug 2017. I am in the process of changing employer and had couple of questions.

My new employer will be applying for my H1 with 3 years validity based on my approved I-140 with previous employer.
1) I am assuming I should apply for my wife's H4 extension and H4 EAD along with my H1B petition. Can someone confirm?
2) Once H1 is approved, my wife will get a new EAD with a three year validity. Is that correct?

My wife recently changed her status frpm F1 OPT to H4 (with EAD). While she was working on F1 OPT she did not pay social security/Medicare tax. She is now working on H4 EAD and I would assume that she now needs to pay Social Secuity/Medicare tax.

Can anyone confirm if we need to pay Social Secuity/Medicare tax on H4 EAD?

PD:4/24

I checked permchecker and it shows numerous PERM approved for my employer for April PD.
One of the approved PERM has my job title, location and country of birth. While digging up more info on dolstats.com for that PERM number, I realized that the city name and education also match my credentials, so it seems that my PERM is approved.

However, when i followed up with the lawyers, they are saying it's still pending and they will not share the A-XXXXX-XXXX number with me.

Any idea what's going on here?

My PD (October 2010) became current today, however I had changed worksite location last year with the same company.
The lawyers re-started the process again and my 2nd PERM is pending with DOL.

I emailed the lawyer and they replied saying that they are reviewing my application to see if i am eligible to apply for I-485.
Any recommendations on how to work with the lawyers to ensure they move ahead with I-485?

Hello,

USCIS mentioned in their FAQ that international travel after applying for H4 EAD is permissible, but their can be 2 possible issues

1) USCIS issues RFE
2) USCIS schedules an appointment for bio-metric.

I don't see anyone getting bio-metric appointment for H4-EAD. So, the only potential issue seems to be if RFE is issued and no one is available to respond.

Has anyone traveled outside USA after applying for H4 EAD? If so, please share your experience.

My employer will be sponsoring the cost associated with filling H4 EAD through an attorney.

However, i plan to change jobs as soon as H4 EAD for my spouse if filled.
Does anyone know if the documents such as receipt notice, approval notice and EAD go to attorney or applicant?

My wife is currently working on F1 OPT and will be going to India to convert to H4 and getting H4 visa stamped on her passport.

She intends to volunteer with her current employer (no compensation) during the time it takes to get H4 EAD.
She will be back again as full time employee once she receives her H4 EAD.

Is there any potential issue with this approach?

Topic: Filing I539 and I765 along with H1 extension

I am in a similar situation. My H-1B Extension will be filed next week. I was planning to file I-539 from my wife (F1 OPT to H4) and I-765(EAD) along with my H1 extension. But as it turns out nothing is concurrent.

H1-B extension will be processed first, followed by COS and then EAD will be processed.
What time frame are we looking at to get H4 EAD in hand for this case?

I have the same concern. If we travel out of country and USCIS runs I-94 they would determine that the applicant has left the country. May be they can figure out that the applicant left the country after applying.

What would be a good time to travel? Should we wait till we get a receipt and able to check the status online?

I believe most employers do not provide approval copy of the I-140.

Is the printout of USCIS status page indicating your I-140 is approved good enough?
Do you recommend any additional document indicating I-140 approval?

1) How do we know if the previous employer has revoked an approved I-140?

2) Most employers do not provide a copy of approved I-140. While submitting the paper based application, should we submit a printout of the USCIS case status page showing "your case was approved on XX date"?

The crucial part is to ensure that rule gets published ASAP and not give OMB any more reason/documents to review. Please don't send any documents to OMB and let's all work towards getting this rule published by asking questions via tweet, conferences etc. We all want to apply for the EAD, but I fear pushing for immediate effect can backfire.
