Let me tell my story in brief: i filed EB1 in March 2007 and during July Fiasco I immediately filled EB2-NIW ( in June 2007) followed by (I-485 based on pending EB2 in july 2007, Received receipt notices in October 2007, RD 31 July 2007, ND 31 oct 2007 ). In Sep 2007, EB1 was got approved. I sent a couple of letters to interlink, but no reply. Called service center and I was told that both the I-140 need to approved to have an interlink. So I immediately filled another I-485 (november 2007) based on approved I-140 Eb1. Then Eb2-NIW was got approved in Feb2008 and finally I ended with two approved I-140s and 2 pending 485s (ofcouse 4 including spouse).

I happend to renew my travel documents and deliberately i renewed by EAD so that I can send letters to TSC. I attached a letter with my EAD application explaning pending 485s to process one of them. nothing happended(july 2008). I made another attempt while renewing my APs (sept 2008) and we received APs and with in two weeks, I got approval notice for EB2 I-485 with EB1 priority date which clearly shows that the files have been interlinked. Welcome noticed based on EB1 and and cards based on Eb1 were received. After one month i received another card based on Eb2 ( thanks to different A number, my wife did not as her A number was same in petitions).

I personally come across few people who got their petitions approved after filling another I-485s. But the same I have seen few could successfully interlinked their petitions. I personally feel, pounding mails, fax would result in successful interlink.

Topic: Linking the EB dates


After several letters TSC to interfile/link my EB-2 (I-40) approval with my pending EB-3-supported I-485 application, I called the 1800 number today to raise a SR and was told by that 'it is against the USCIS policy to interfile or link a new I-40 approval with a pending I-485 application". Is anyone aware of this "new policy"?
Also, the person I spoke with said the only way to go is to file a new I-485 with the newly approved I-140



There is no new policy. I sent several letters for linking EB1 and EB2 ( but I also two 485s). Infact they linked and I received the cards too. For matter for fact, both the 485s got approved and received two card and recently returned one to USCIS.

No, I did not recieve any welcome or Approval notice, Only CPO mails. What is the sequence...

485s based on EB1 have been approved, but I could see soft LUDs on EB2 485s.

Then it should not be a problem. I have noticed few IT people got visa extention without any hassle. He should be fine. Ask him to have all needed douments, particulary LCA and I-129 full petition which were asked everyone paritcularly if the petition is not in the PIMS.

Yes expectluck...You guessed it correct. I applied at chennai consulate. If he/she is a researcher (particularly science/tech), the chances of subjecting to additional adminstrative processing is very high. My case, infact, it is the same employer, already stamped twice but still was subjected to AAP. Ask your friend to go to Delhi which looks to be easy to get through for a researcher.

I received CRIS emails ( primary and dependent) with status "Card production ordered". Three weeks back I called TSC and found that My name check was pending where as wife's name check was cleared. Rightnow I am out of county and applied for H1B visa 15 days back which is pending for Additional adminstrative process. Fortunately we have valid approved advance parole.
