Or can it be done the other way round, file for a h1 transfer, file new perm and I-140? Anyone done this before?

Is it possible to take a new position at this time. New company files for perm, then I-140 and then transfers my H1 to itself? Will I get a 3 year extension based on that? Is that possible?

Oh just because I had another backup I-140 (EB2 - Dec 2003) pending. Now if this one goes south, thats when I think I'll be in real trouble and will file for new perm application. Make sense? If you have any suggestions on how this can be handled better, please share.

I am in my 9th year extension on my H1. I have had one I-140 denied (EB3, now pending at AAO after A2P RFE) and recently got same RFE on my second I-140 (EB2) with the same employer. I am just worried that this one might get denied too. Now I read in so many posts that you can have a perm application and a corresponding 140 as a backup plan while waiting for your I-140 appeal. Can I do that in my 9th year? My question is is that even a option for me? Or is it just for people who are well under their 6th H1 year?

Any help/suggestions would be greatly appreciated.
