Topic: Filing EAD by self
I filed an EAD myself for my daugter by mail, got approval within about 60 days.
Supporting documents where just I-485 receipt copy for my daughter, photos, and passport pages, and a $180 check (old fees). |
Topic: NSC - Customer Service Hanging up
I have experienced several unfriendly and utterly rude responses from the NSC, some due there does have the tendency to hang up in seconds, sometimes after yelling at you that you have reached the wrong number or such.
Keep calling until you get someone to speak to you as a human being. |
Topic: Travel Question
If you have an AP< you must show it at the point of entry, and will go to the back room for a short interrogation.
If your APs will be approved while you (or your wife) is abroad, you can have the lawyer Fedex these APs to you overeas, or you can state that your AP was approved but you do not have the original document for the obvious reasons, and they will admit you as a parolee.
It may become problematic if the AP is not approved and H expires by the time you need to return. Go to InfoPass, bring your plane tickets with you, and they may be able to expedite your AP for you. |
Topic: Full Time on H1B and Part Time Job on EAD
I have done this, and was advised by my primary employer's lawyer:
Once you do any job using EAD (e.g. consulting), you effectively change your status to "parolee", and right then you need to fill a new I-9 form with your primary employer to change your status accordingly, and file it with a copy of your EAD card with your primary employer.
Also, once you receive an AP, anytime you travel outside the US, you must show your AP when you return, even if your H-1/H-4 status is still valid, and they will admit you in Pparolee" status, which requires you to change your I-9 to the same as above.
This "double status" situation is very common, and should not cause any problem if you are late with I-9 filing, or not file it at all. |
Topic: Very Important bill for namecheck introduced in HOUSE!
Perhaps I am too passimistic, but based on my past experience, every time one bottle-neck is resolved in the immigration system, another one appears in its place.
I will save you the details, but many of us have been in the system long enough to know that that is exactly what happend so far, and in my opinion, if this bill indeed passes (which I doubt), it will happen again, and we'll be stock elsewhere.
Besides, this democratic majority congress has done absolutely nothing since they got elected and until now, and I am pretty sure they won't do much good at least until a new president is in office.
Also, I have the feeling that our congress cares more about the illegal immigrants than they care about us, and I doubt that these letters will change their minds.
Sorry to sound discouraging, but I'd rather set the expecations low than get dissapointed later. |

One word of caution, when you contact your Senator, your lawyer may thereafter refuse to work on your case,
so either do this in coordination with the lawyer, or wait until you lost all faith in your lawyer. |
Topic: How long has your FBI name check been pending?
Mine was pending for approximately 14 months.
Inquiery through a senator has probably caused them to expedite. |
Topic: Congressman Response time: Name check
O am EB2 ROW(Ukraine), and my visa number is current for my PD almost every month since I filed.
Still, I guess there could have been a reason to hold till Oct 1 due to per-country visa limits, but now there is no reason whatsoever.
I talked to an IO at NSC, he said there is no other reason for my case waiting aside of them being overloaded.
I also did a referral with the customer service, maybe that will cause them to pick up the file.
Next week I will try an InfoPass... |
Topic: Congressman Response time: Name check
I got a confirmation letter from senator's caswork office in about 1 week, then it took almost 4 months to get a response from the FBI. I had to nudge the casework person about 3 months into the wait period, and had them resubmit the request.
The response said the name check cleared about at the same time the FBI generated the response.
Now, it is well over 60 days since name check has cleared, but the case has not moved, not even a soft LUD. |

I recommend you to wait until FP, and one of AP or H-1 extension approval.
You may try to send a letter to the service center with your travel plans, and maybe even a copy of the tickets,
and ask them to expedite the AP.
Legally, once your I-485 was receipted, you are elligible for temporary releif (i.e. AP and EAD), and must be provided within 90 days of filing. If the USCIS faisl to provide these benefits, you are not at fault, and in the worst case you can try to get back into US with just your I-485 receipt notice (original), which works most of the time too. But in the unlikely event that it would not, I would recommend to delay your travel plans. |
