Hi,

My company is asking me to move to a different location due to business reasons. I have approved I140 and my priority date is feb 2011 EB2 India. Does the company need to refile labor and apply for I140 again ?

The role and title of the job is not going to change.
Please help me understand what needs to be done in this scneario.

Yes, I have a valid approved I140. I am more concerned about her eligibility because of that rule. I didnt understand the intent and scope of the rule.

Absolutely YES. She is eligible.

The meaning of the above mentioned point is - Some commenters requested that they give EAD to those H1B spouses who have applied for H1B and were not picked in the lottery. Which the USCIS denied.

Think logically, if they can allow H1Bs, F1s and other visas to switch back to H4 and Apply for H4-EAD, then why won't they allow people who have been legally on H4 , tried to apply H1 but were not picked in lottery. Doesn't make sense right?

Don't worry my friend. Your wife is eligible. If it makes you feel any better, I am on H4 , applied for H1 last year, did not get picked in lottery. And I am confident that what I said in the above few statements is true. Otherwise, it just doesn't make sense. What wrong did those poor H4's do in applying for H1 and not getting picked, that they shouldn't be given EAD?
