Hi Vicky, thanks for the reply.
Just so I understand this clearly, you are saying USCIS will process all three applications together under premium and the decision can be known in two weeks on the three? or does it make a decision on H1 and H4 first with in two weeks and then start to process the EAD and the decision on EAD can take much longer?

(Why I am asking is because I hear that USCIS approves H4 first and then starts to work on EAD application).



Other people have weighed in their experiences.

Just like H4 is chained to H1-B, H4-EAD is chained to H4.
First H1 gets approved in premium and then USCIS approves H4 in same time frame as courtesy.
Similarly, since H4 is now approved, H4-EAD should get approved in same premium processing window.

Again, please do remember that except H1-B approval in premium processing window, USCIS is under no obligation to approve H-4 and H4-EAD under premium processing but all three usually gets approved in same time frame.

Hi,

I am changing my status to H4 from H1 and file for H4 EAD.

If we apply my husband's H1 renewal in premium processing and tag along my H4 Change of Status and EAD together, how long will it take to get approval on my EAD? Will EAD be also approved along with H1 and H4 in premium?

Please advise.




There is no premium processing for H4 or H4EAD.
When H1 is filed under premium and H4/H4EAD is tagged along with it, USCIS approves all three as a matter of courtesy.

H1 and H4 would be valid for extension where as H4 EAD would not be eligible for extension.

If you are going for PP option then you may take a chance with filing all three together and worst case H4 EAD extension application would be rejected and fees returned (make sure to give separate checks for fees)

However, I have not found anyone who has actually gone through this in reality.
As you said, there is no harm in trying.
Just want to see if this goes through so that my spouse gets her H4EAD before it gets rescinded, god forbid. :(

I was in a similar situation sometime back. And my lawyer didn't go ahead with H4 EAD concurrent filing even though at first their thought was they could. So most likely your H4 EAD extension won't be valid as you are outside the 120 day prior window.

Since your lawyer didn't go through with the actual filing, we don't know whether USCIS will renew H4EAD or not outside of 120 days window.

I will probably apply for the renewal and will update how it went.

Hello Everyone,

My wife already has H4-EAD, which is valid till Dec'2018.

I am changing jobs and transferring my H1-B visa. I already have I-140 approved from my previous employer.
As part of transfer, my new employer will be requesting for a new 3 year H1-B petition.
Employer is also filing for H4 extension and H4-EAD extension to align with the new H1-B petition.

My question is whether this is the right process or not? I know that H4-EAD can be renewed 120 days (4 months) before expiration date.
Since my spouse's H4-EAD is valid till Dec'2018, will USCIS grant a new EAD to align with the expiration date of new/extended H1-B? Or will they reject it saying that current H4-EAD is still valid and can be renewed only 120 days before it expires?

Any comments would be appreciated.

Our opinion doesnot matters. What matters is how the new admin takes it up and plans further action.
Even if its cancelled today no one will come out and oppose, as is the general tendency with our selfish egoistic desi public. they will cry on trackitt, twitter and FB, but wont even do a single thing. Point is we are in self denial, although we know worst is to happen. All desi people believe in facebook pages like 'H4 Visa a curse', SIIA etc, when clearly they don't do anything, but just copy paste from news articles and blogs.

Anyone here from IV? I would be interested to know their strategy? If they are willing to fight then I can definitely donate 100-200 recurring donations. One of my colleague is a newbie in IV, but he too afraid to ask about H4 EAD. He said as soon as anyone asks, they are told to focus on HR 392 and not to even think about H4 EAD.



At the time when H4-EAD was being fought for, there were lots of meetings in DC which lead to successful rule implementation. So it's wrong to say that people don't participate.
HR 392 got so many sponsors in congress because desis went out and met their respective congressmen.
If anyone can't participate physically, the next best thing to do is to contribute financially to IV.
IV may be rude but at least they do fight legally in court on our behalf.

P.S. -- On another note, I do agree though that once any desi gets his/her GC, they have the attitude that no more people should be allowed afterwards. I have had many interactions with people like these. I was very surprised and shocked to see a lot of opposition to H4-EAD from desi junta.

Is there any way to get details about the PWD with case number.
My case was determined but, as per lawyer, the wages came too high.

I know that DOL releases disclosure data but it comes out once a year in July.
I could wait till next July (2018) to find out the wage details but I am hoping someone knows if there is a way to pull this data from DOL using case number.

I mean, DOL does release disclosure data yearly, containing information about all the PWD cases so it's not private data, right?

This notice in not related to H4-EAD but it does do away with one program which Obama era implemented.

Mine Filled on 04/27/2015, I have no update from Lawyer. not sure. My State is NJ too.

PWD submission date = 04/27/2017
Determination Date -- Pending
State -- NJ

It is 104 days today and still waiting. Does not look good to me.



Get the case number and track it on DOL site. I should be determined by now.
PWD is not a type of request which gets rejected or denied.
Lawyer might not be keeping an eye on the case or doesn't want to update you for some reason.

H4 EAD can only be undone via rule making process. So far no official news have been published on this. This is all just fear mongering.



I and lot of us here agree that H4 EAD can be undone only by rule making process.

The point is that current DOJ under Jeff Sessions is expected to introduce the rule making process to repeal/reverse H4 EAD.
The reason why lot of us think this is expected is because of DOJ's reluctance to fight this case in appeals court.
They keep asking for more time and in the last court proceedings, DOJ submitted a secret report about their plan to handle H4 EAD which might make the current court case irrelevant.
What could that report say other than that DOJ is planning to reverse it?

The combination of all these things point in negative direction for this H4 EAD rule.

I am very sad about this as I am direct beneficiary of this rule.
However, be practical and be ready (at least mentally) if worse comes to worse.

Additionally, the lawyer who is on behalf of "Save Jobs USA" has an opinion that H4 rule is on it's way out.
