Please do not raise hopes..
I have been following Ron G since 2011..
He tends to become overtly optimistic based on any big or little developments in WH related to immigration.

That's why my question to all the members here was:
DOES ANY ONE ELSE BELIEVE IT ???

According to Ron-G,

"As far as I know, pre-registration is happening."-- for approved I-140 to get EADs
And he is also very optimistic about statute reinterpretation..to eliminate dependent counts from employment based GC

All of this he is expecting to be announced, on 20th March 2015.
Does any one in this forum believe it ??

During the period until one year following the termination of your employment for what so ever reason, you shall not directly or indirectly solicit the business of or provide any software engineering, consulting or programming services to any customer of the company (regardless whether or not you personally dealt with that party during that employment) or to any customer (or end user of any customer) of the company for which or for whose benefit you provided services during your employment.

Above is the non-compete I have signed with my employer.
The issue is that the current customer that I am working for was found by me and introduced to my employer by me.
In such a scenario can my employer enforce non-compete, after I leave him, claiming the customer to be 'HIS customer'

In my case the restriction is not to work for 'HIS' customer for one year.(The employer never knew about the customer before I introduced him and brought business)

Standing ovation for your excellent English and presentation of case for the legals.

But the big question is how do we lobby our case to the people who really matter ?
None of us are united..
we have no common representation..
People having H1 are worried that people on H4 will be the new competition if they get EADs..
People having I-140 approved for a long time wonder why should the freshly approved I-140s also get EADs with them ?
They think it's an injustice that the newly approved I-140s will not have to wait so long to get the EADs...

When we Indians fight for a cause, we want to make sure, that it's only 'me' who gets the benefit.. if my friend, colleague, his/her spouse, or any junior gets benefited..then that's INJUSTICE.

I know many of you will disagree with what I am saying, but I believe, this is why we got peanuts (or carrots or middle finger) from Obama's EO.. keep fighting among ourselves !!

Topic: Can an Employer refuses to apply I-485 for you?

What options do we have if the employer refuses to provide the EVL ?

My employer filed my perm after I worked for 3 years with him.
Then he filed I-140 at the last week of the perm getting expired.
I have no reason to believe he will be ready to file my I-485 as soon as the dates become current.

What options do we have if the employer refuses to provide the EVL ?

Your problem is that you are too proud to be a FTE and think that you know about everything.
I have been a FTE and also worked with these small companies. And am pretty much aware how to get out of such situations.

My suggestion is for the OP, if you don't like it, it's not mine nor OP's problem.

That's what you are asking the OP to do..
Once you are on H4,or B2, you won't get any interview calls, because technically you dont have work permit...
Keep explaining to all the recruiters.. and best of luck with that

How many H4s or B2s have actually got a job here in US ?
Look at the EAD for H4 thread..
Theoretically your solution looks feasible, but it will end up with the OP sitting home with out work. Nothing wrong with that if the OP does not mind.

Practically, only small employers can save his H1, in this situation(and keep him employed).

That's the fact.. OP has just 3 options: go back to home country, sit home with H4/B2/F1/etc etc or join ANY damn employer and who agrees to get his H1 processed immediately

Yes..
joining one of these shady, fly-by-night desi consulting companies is his only option at this point of time.
You will know this only when you are given a week's notice and asked to find something else.
It feels good and proud to be working for these big clients, but desperate times call for desparate measures.
