if your spouse has lesser points than you then the points come down.
in that case total points = 70% of ur points + 30% of ur spouse's points.
Im in the same boat as you..I think the point system is not going to do good to ppl who have been stuck in GC queue for 5-10 years. I wish there was some point for number of years we had waited for GC ;).(pun intended)

I'm in a similar situation, planning a job switch though i dont have any active offer unlike you. here are my thoughts.
Chances of outright rejection are slim, you could get an RFE for which you have few months time to respond and you can continue working. You can plan to get another job in that time or PP will be back by then.
Even if your petition is denied in the remotest of the case, since you have a 3 year valid visa and valid II40 you should be able to get another employer. I think its safe to join to join another company with just the receipt.

I have one added question, I too have valid visa for 3 years, is it okay to travel outside US when the H1 Petition is pending processing? Will there be any problem at port of entry? I have a travel planned in August and I don't expect PP to return for atleast 6 months!

Start a petition to stop H1-Bs, you should be kidding me. This is the kind of attitude that always pulls us down and as an Immigrant community we can never mobilize to make any impact. Everyone is just worried about their immediate problem. Those in H1's are not bothered about F1/OPT. Those already in H1 don't want others to come on H1. Those working on H1 for American Software companies blame Indian Consultancies for their GC wait. Non-software folks blame entire IT community. EB2's and EB-3's blame EB-1s. EB2's also blame EB3's for porting to EB2. Northies blame Southies.. everyone else blames Telugu community. and once you get GC you dont care anymore, may be you will want to deport all immigrants. I think i have seen all possible divisions in this forum. No wonder its hard to get 100k signatures for a petition. We need need to find leaders who can see through this differences and unite the Immigrant community as one. And these leaders should be one among us and not any immigration lawyer, only then we will have some hope.

you are living in fools paradise. Trump is not going to any good to Immigration community,( i doubt if he will do anything good other than to himself). It doesn't matter to him if ur with a body shopping company or not. Trump wants to kick out all immigrants.. now you can quote his previous statements that he is pro legal immigration, but it doesn't mean anything, he changes his views everyday. even his own campaign doesnt know what he is going to blurt out next..i cant change your political view and im not trying to, but it really baffles me how u cannot see through his demagoguery. god save the world if he is to be the next president.

Most of the comments talks about rejecting this rule completely. I think its not the right thing to do. Reject mean you dont want this rule at all, i.e it shouldnt be implemented at all. comments should be more constructive like what are the changes that we want for the current rule.. that is the whole idea of uscis asking for comments. rejecting the rule is not going to help anyone..by the way most comments are i think there is a chance that uscis may scrap the rule altogether.. noone wants to go thru another rule making process again and further delaying this process..

I think its good its not reported in mainstream media. Its election time, and politicians will use this to play the anti-immigration card.. if you listen to trump and cruz, they are already calling for a stop on h1-b program.. so dont expect any sympathy from mainstream media or american public..

I was reading at comments, and some of the comments by h1-b folks are also not very positive. Most are trying to vent out their frustration.. guys open ur eyes, see whats happening around u... watch tv, read newpapers.. its election time and the general american sentiment is to keep immigrants out.. mostly illegal and refugees.. but unfortunately we legal folks too.. i think we should give some credit to uscis and obama administration to atleast bring up this rule at this time..even though its a small step.. by all these negative comments we are jeopardizing even this..

After all these years, we should have anticipated that USCIS will not just like that give us EAD and free us from this slavery.
The immigration system is this country is broken and it will remain like this for the benefit of employers and attorneys.
Anyways, something is better than nothing.
positives i can see , employee can retain the I-140 in case of job change, that way i can keep extending my h1 and spouse can keep extending the h4-ead without worrying about previous employer revoking it.
reapplying for perm and i-140 with new employer seems to be a pain, but atleast there is no deadline tat it has to be done before the h1 term expires.
already almost a decade in h1..seems like i have to remain in h1 for another decade!!

I dont want to discourage you. But its really hard to get tech jobs without experience and an indian college degree. unless you have contacts who can get you interviews.
We tried for my wife, after few months of futile job hunt, she has decided to join masters program here.
the whole experience of job hunt was really painful and she was almost on the verge of depression, so we finally decided to join for masters.
desi consultancies who offer free training and placement will want you to fake resume. they wont tell u upfront, they will claim they have lots of clients and will place you immediately. but in truth, they just fake resumes and apply. unless ur ready for tat, dont waste your time. my wife wasted 2 months attending their training and finally when they faked her resume to have 8-10 years experience, we backed out.
I hope you have better experience, good luck with your job hunt!

lets wait for the full text of the rule before jumping into conclusions. Rule is not just about I-140 ead, it talks about I-140 Portability as well. This rule does makes much more sense if you consider it along with i-140 portability.
If you can keep ur i-140, you just need an employer to sponsor your h1-b to maintain your non-immigrant status. In tat case you dont need i-140 ead at all, unless in a compelling situation like your employer suddenly fires you or goes bankrupt and not able to sponsor h1.
i believe the key here is i-140 portability, i dont see much takers for i-140 ead which explains the compelling situation specified in the draft i-756 form.

I would like to share my experience and hope it helps someone..
I feel that getting a job in h4 ead is very tough without prior experience. My wife has a mtech degree in electrical engineering from india, and she is brilliant and smart (im not saying just because its my wife :) ). we have been looking for a job since more than 2 months with no luck. First we tried for entry level electrical engineering openings, there aren't many jobs, but even the few we applied there was no response. Basically they were looking for someone with US college degree or someone with US experience.
Seeing her resume in jobsites, she was approached by some desi consultancy, which promised training and placement immediately as BA. Desperate to find a job, we believed their sweet words. After few weeks of training, their recruiter(a guy from india) started marketing her resume. Their way of marketing outrageous, they have set of resume for each domain and requirements. They go to dice, search for jobs, and update the resume accordingly. On a single day you could be a 10 years experienced senior BA with financial experience or a 10 year exp BA with pharma experience. Everything in that resume, including date of birth, is fake. My advice to you guys is to stay away from some consultancies. There is no dignity in getting a job like that. i am wondering why USCIS is not taking any action to cut down such consultancies.. as far as i understand there is no entry level IT job in US, unless ur a graduate from US university or have atleast 5 years of experience. So we are back to square one and weighing our options. Appreciate if everyone could share their success stories, so that we could try in that way. Getting H4 EAD was a good break, but for spouses with Indian college degrees and no work experience getting a job seems lot harder!

it depends.. it took 15 days for us to get the card once the status was changed to approved online. In between we did get the approval letter. Some ppl have got it faster..

Do you know what will happen if the I-140 is withdrawn or revoked AFTER the EAD has been issued? As far i know there is nobody has a clear answer to this. So you may run the risk of losing EAD if your previous employer withdraws I-140.

Its great that may of you have good tech skills and you are eager to find out if someone got approved.. but remember what you are doing is in a way trying to hack uscis website and its illegal. Please stop doing this and have some patience. its too early to expect approvals!! By the way the you guys are running scan, I'm expecting uscis to either take down the case status check option or to introduce CAPTCHA soon!

my wife has a masters degree in electrical engineering from India (but with no professional experience). Is it possible to get a job in electrical engineering field with an EAD. I know its legally possible to do any work with EAD, I wanted to know the chances of getting a job in a non-IT field. Is there anyone from non-IT field who can advise?

Please pardon me if this is a wrong forum to post such questions, since most of us has already applied for EAD, I thought we could possibly discuss the next steps to get ready for the Job market.
