Friends,

Need your help and advice here. I am going to consult an attorney, but your inputs would help me in driving the questions and the process with the attorney.

My wife is currently on F1 STEM OPT EAD(F1 stamping not done yet) and is valid until Aug 2017. We are travelling to India on October 2016 and as per my knowledge, F1 stamping in India after graduation is going to be a nightmare. So I thought about some options - 1) If H1B gets approved, no action needed. All is well, she just needs to get her H1B stamped 2) If H1B doesn't get picked up in lottery, apply for H4 COS and EAD together 3) Travel to India on October with her F1 and get the H4 stamping done directly, return and apply for H4 EAD.

1) Given that I have 6 more months for my India travel,Can you please advice on option 2 and 3, which one should i choose to have less gap on her employment?
2) What if i don't get the approval before my India travel?
3) Any successful experiences on getting the F1 stamping done in India after graduation?

No, it won't. I have my I 140 approved and we marked the immigration petition question as 'No' on I 539, since the I 140 petition was filed on my behalf

Guys,

My wife's F1 got approved today. Applied 17th October through ELIS and processed at CSC. Raised an expedite service request last week and today my wife received an email that they are actively looking onto her case and the application was approved with 2 hrs. Good luck to you all.

Filed on Oct 17th through ELIS and still waiting. Raised an expedite request and got response from USCIS that my case is currently being adjudicated. I am hoping something this week. does anyone know how long do they take after expediting the application?

Freinds, please help with this. I am kind of confused on what to do.

I am on my 9 year of H1B with approved I140. My wife is currently on H4 visa, pursuing her masters at university of utah and I have applied change of status to F1 for her(in order to get OPT) last month and awaiting results. Assuming that, the H4 EAD rule gets effective starting Jan 2015 and her status is not changed to F1, can I apply for H4 EAD? Should I cancel the COS application, if the H4 EAD rule becomes effective starting January? Please advice. Which route is safest and faster?

My company has just initiated the GC process for me. I understand that PWD is the first step in the process, my immig dept told me that they even can't file the PWD, since it's suspended for time being? Can I go-ahead and file the PWD at least or how it works? Please help me out.

Also, can I go-ahed and start the recruitment process w/o the PWD?
