vkgc2005's Immigration Cases

I had an interview 3-4 months back and the officer said everything on my file looked fine.
I am thinking of using AC21.
Would that trigger another interview ? Or would there be an RFE ?
Would my case be transferred back to service center from the local office, if I file for AC21.
Please advice!

The only thing I was concerned is, my husband's employer says that his I140 was withdrawn, but I think that he did not do it or forgot to do it.

Will that affect our current I-485 application?

Our I485 was applied on July 2007. Both of us were in our H1B.

My husband's I140 was applied on Jan 2008. Finally he quit the company and joined fulltime using EAD in Aug 2008.

Even if his employer withdraws 140 nothing to scare as long as your husband changed job after 6 months of applying 485.

I just received CAL drivers licence renewal form, can i use EAD for renewal?

Bro, just go with your existing Original DL. You will most likely get a renewed DL with a 5 year extension. My friends got 5 year extension here in SO CAL.

When the RFE response was filed early this month, I got a notification that case processing has resumed and I should expect to receive written decision or update within 60 days.

every body will recieve the notification after the rfe response. this is not we are asking. after the RFE response how many soft lud's you got. that's what we are asking.

It is not a typo. It was current during Q4 of last year. I heard that another friend of mine got a RFE and his priority date is also around April 2006. May be he will get the GC too.

After responding to RFE what is the Lud Sequence? i mean continuos LUD's or straight approval.

RFE clearly suggests their is some kind of date of marriage discrepancy, means something is not clear on the marriage certificate in terms of the date.

Anyways now you can provide the wedding photos, affidavits from the witnesses who were present during your wedding, Passport data pages which shows the relationship and spouse's names.

These proof should suffice.

In India you guys know about the date format right? we do like dd/mm/yy. i think they got confused with this date

RFE - Details

ME - Submit any secondary evidence in your possession to support the information you have provided about your marriage and calimed relation ship to "my wifename". Evidence provided has discrepancy with the date of marriage provided on the certificate of marriage

My wife - Submit any secondary evidence in you possession to support the information you have provided about your marriage and claimed relation ship to the principal applicant

Can any of you give me some adivce on what need to submit for these kind of RFE's. I already submitted Marriage Certificate

You are right ..

1) It may no be EVL as I am with the same employer (Govt entity)for over 7 years .
2) I have a daughter but she is born here in US and hence no LUD for her :).
3) It may not be marriage certificate as My wife and I have had H1-H4 for over 7 years now . So sending them an old copy of marriage certificate may not help much unless thay have lost it from my file
4) I am suspecting medical or biometric issue here. We did do the X-rays in 2007 when we filed our 485's but they may have expired :)

There was a rfe on 485 and was told that I was to get a decision in 60 days. Waited 60 days and nothing happened so I opened up a service request and got a response indicating that my case is under further review and that I would have to wait 6 months before any decisions is made. I am really confused, do I really have to wait this long and any ideas about what it means by their statement that the case is under further review. How would I know that my name check has been cleared. Please let me know

these kind of RFE's how can you prove? what did you submit for this..! Can you tell us what did you submit in your case?

I guess there must have been some activity today because I also got an email about RFE today. My PD is 11/2005 which was current for 2 months in 2008 and then fell back again.
I guess we will all know once the attorney gets the RFE. Please provide updates once you find more info.

We are in exactly same status and received an RFE for out of status for 11 months.
