Topic: Help Needed - I think i got my GC approved, But my dates are not even current

Be happy you got your green card approved. Check with your lawyer and keep it.
I hope you do what is best for you and not what is best for your parents.
You need to make your own decisions.
I hope you marry your american girlfriend.
I know of a similar case years ago.
My friend (originally from India) went back home to talk to the "arranged bride" and told her that he can't marry her because she is in love with a SouthAmerican girl. She understood. He flew back to America and married his girlfriend. HIs parents were very upset, mad, etc.. for over one year. Now, they life in happiness and his parents come to visit once a year to see their grandkids.

Topic: husband's still pending

Hi,
My I-485 was approved three weeks ago (I am the primary).
My husband's applications hasn't been approved yet.
We called three weeks ago and the IO told us that he will send an e-mail to the officer that approved my case and request him to REFRESH my husband's fingerprints file.
He said to call back in two weeks.

We called back last Thursday and a different IO assisted us. He said that "Refreshing fingerprints" is not allowed anymore.
He said my husband needs to go through fingerprints and name check again.
We haven't received any fingerprints notice yet. Can someone help me understand this?
Is this going to be another year of waiting?
What can I do to expedite this situation?

Topic: Card approved after 5 years of waiting.

I just want to share my story with you and encourage everybody to keep your hopes, faith and patience high.
I got my card approved today after 5 years of waiting.
My first application was submitted in year 2003 and pulled out in 2005 because my employer shutdown.
My second application was submitted in July 2006 through Nebraska. It was transferred to National BEnefits Center a year after, then to Oklahoma City for the interview (Nov 1, 2007) and then transferred back to Nebraska in February 2008.
My case was overdue one year. I had two RFEs during year 2007: TB test and copies of criminal records because my fingerprints are not cleared.
I went to several Infopass appointments to get no input but discouragement from the lady behind the window. Last time I went for an INfopass (Feb 2008) she told me that the reason why my case is still pending and being moved all over the places is because I have bad luck. I froze and didn't reply anything back, and left in tears.
Later on, I called to Customer SErvice to open an inquiry. The customer serv rep told me to call back in 45 days if I haven't heard anything from Immigration. I called back in 45 days (April 7th) to find out that my enquiry hasn't been assigned to an officer yet. She told me that I need to open a second inquiry and call back in 45 days.
I was so frustrated and told her that this is a joke. I should not be opening inquiries over the inquiry. Anyway, I called back last WEdnesday (day 30) to ask if my inquiry has already been assigned to an officer. The cust rep couldn't tell me anything but updated my inquiry with more information.
I called my lawyer to start the lawsuit that he suggested two months ago. He would charge a discount fee of $3,000.00
Anyway, I am glad I got this approval e-mail today. We were going to sign contract with the lawyer next week.
I just want to wish everybody good luck and keep positive.
The card will be approve sooner or later, it will happen at the end.

Igorojas:
How did you manage to get the Officer's attention? Where did you call?
I have been calling and opened already two Inquiries. The first one was Opened in FEbruary and nobody was assigned to my case. I am suppose to call back in June 1st to find out if someone has checked by second inquiry.
My I-485 has been pending for 1.5 year. No progress at all.

I was already married in my home country when I applied for I-485.
We used our country marriage certificate and a certified translation.

Topic: Lawyer wants to sue

My I-485 (EB2) file has been around the country (First Nebraska, then National SErvice Centers, Oklahoma City (local office) and now back to Nebraska). My application was submitted in August 2006. My lawyer said that my case should have been adjudicated in Oklahoma City (where we were interviewed).
Nebraska service center is currenlty processing June 2007.
I called in FEbruary to Customer SErvice an opened an inquiry, the rep told me to call in 45 days.
I called last week and the helpless customer service rep suggested to open a second inquiry for the first inquiry.
I am just so frustrated with this.
I called my lawyer last week and asked him: what else can we do?
His advice is to sue immigration for delayed/errors.
He said that he has sued immigration 35 times and have won all the cases.

Any advice is welcome.

Topic: File stuck in Local office

My I-485 was origanally submitted through Nebraska in August 2006.
A year later, it was transferred to the National Benefits Center.
On NOvembe 1s, 2007 I had my interview at the local immigration Office (Oklahoma).
On February 8th, 2008 my case was transferred back to Nebraska.
I was expecting adjudication at the oklahoma City office.
My last LUD was on 02/29/08 "File was transferred to NEbraska and is now pending...."

I think my case has been stuck because I have a problem with fingerprints (not clear).
When I had the interview, I was asked for criminal records. I sent the criminal records two weeks after.
The immigration officer at Oklahoma City office told me that I would hear something in 8 weeks.
Yes, he was right. My case was transferred to NEbraska and still waiting.
Any thoughts, why my case was trasnferred back to Nebraska?
My name check was already cleared a year ago.

Topic: FILE TRANSFERED TO ANOTHER OFFICE

My case was originally submitted through the NEbraska SErvice Center in July 2006.
Then, my case was transferred to the National BEnefits Center in July 2007. Then my file was moved to Oklahoma City for the interview. I had the interview in NOvember 1st, 2007.
My problem is that my fingerprints are not cleared, so in the interview I was asked for criminal records. Criminal records were submitted the following week.
The Immigration OFficer said he will be contacting me in eight weeks .
I never heard anything back from Immigration. I just found out my case was transferred to Nebraska in FEbruary 8th,2008.
My case should have been adjudicated in Oklahoma City. There is nothing pending. My name was cleared a year ago.
My case is stuck in the system.

I have the same problem. I went to the interview in November 1st. I was told my fingerprints are not clear enough so the Officer requested Criminal records instead.
I provided the criminal records two weeks after and haven't heard anything from Immigration yet.
I have gone twice to the iNfopass appointments and the customer service lady can't help at all.
She said I have to wait another 12 weeks. It has already been 3 months since the interview.

Topic: TWO I-485 applications

Nadie,
My husband has been on his green card process EB3 since 2003. THis is his third application.
The two previous one were cancelled or pulled out because his company laid off personnel in 2001 and later in 2002.

This is my second I-485 application through my employers. My first one was pulled out because the plant where I used to work SHUTDOWN.

So, Do you still wonder why we tried to protect our luck and keep each one's I-485 application separate?

Topic: TWO I-485 applications

Thanks for all the input. I am very concerned at this point.
My case is right now at the National Benefits Center, and we will have our interview on November the 1st.
My application was submitted a year ago and I am EB2.
My husband's I-485 was submitted in August and he didn't get a LIN number in his receipt Notice.
All he got is a letter saying that his case was transferred from Vermont to the Texas Service Center.
The receipt number starts with EAC instead of LIN?
Does anybody know what is the difference.

Topic: TWO I-485 applications

My husband and I are currently holding two I-485 application receipts, each one.

Our employers (different employers) are both sponsoring us independently.
My husband is my dependant in my I-485 application and I am his dependant in his I-485 application.

Will Immigration cancel both if they figure this out?

Do we need to cancel one?
