Topic: Case moved to BALCA..Need help

- What happens after the case is moved to BALCA.. Does attorney has to communicate anything to BALCA saying we are willing to proceed or is it automatically pending ?
I think employer/attoney has to confirm to docket the case to BALCA.

Can we withdraw the case at any given point of time ? Yes. You can withdraw the case any time.

- I think my options are to get an extension after Dec3,2013 for a year . Withdraw the case from BALCA and file a new one.
Is that correct ?
You can get the H1 extention from Dec3 since that will qualify for perm pending for 365 days . Once you get the extention you can withdraw the case and file new one.

- I know there is a clause that we cannot file NEW PERM while the old is pending with BALCA..but I wanted to know while the old case is pending can we start the recruitment/advertisement phase for a New PERM ? We will file only after the old ase is removed..Is that possible ?
Check with attorney if you can start the recruitment/advertisement phase for a New PERM before withdrwaing the old case.

Topic: I94 And Passport Expiration Date - IMP Information

I know someone who was in similar situation and was successfully got the new I-94 just by visiting CBP office at airport. I think you have to get your passport renewed and then go to CBP office. Have you renewed your passort?

Topic: What happens to about 20% of the PERM cases pending in audit?

I found this from other posts earlier. Below is link where DOL has disclosure data for all the cases that are processed and decision made(by quarterly/yearly). Unfortunately, this does not include in-process cases.
