I personally wouldn't attach great significance to all the wordings. It is not as if all the lines have been closely paid attention to & carefully drafted to convey exact meaning. Given that it is a Government agency and that they had to get out a year end status report, some junior person/team would be tasked with creating this report & he/she has done a cut/copy/paste of all the available info.

But File your status here. H1B docs of your primary applicant and your H1B and 3payslips are required. You can file yourself. Once you get a receipt number you will be in status since your COS application is pending.




But just be aware that if you file for COS you cannot travel out of the country without deeming your application as abandoned. If OP wants to travel to India, her best bet is to apply for H4 visa in India & enter on that visa. Alternatively, she can apply for COS once she comes back from her travel.

Based on your spouse's approved I-140, if you are on H4, you can qualify for EAD. But that will need a Change of Status. Change of Status takes around 2-3 months. I do not think you can keep working after you have filed for COS.

Thank you for taking the time to respond to my question. H4 EAD is my best bet since the hope to file for AOS with approved I140 doesn't seem to happen anytime soon. Thanks again.



Alternatively, you can exit US, apply for a H4 visa & enter on H4 status. This will shave off the time required for COS(2-3 months). Of course, you will need to wait for EAD to arrive before starting work.

Hi,

My I 140 approved but I did not complete my 6 years of H1.

Currently, my wife is in India now and she is due for F1 visa interview in another 10 days. Considering my situation can my wife get EAD? Also should we cancel F1 visa interview?

Please advice what I should be doing at this situation?

Anyone applying for F1 needs to show non-immigrant intention under current rules. The fact that you have applied for I-140 indicates your intention to immigrate, which is a cause to deny F1 visa. Have you checked this prior to applying for F1 visa?

So you will still have H4s who, after spending 6 years or more here, without a EAD just because their spouses shifted companies & are now unable to file for AOS (as they don't have I140 yet from the new company)

No, no,no! It is a mistake to think EO will make this rule redundant. I-140 from past employer gives you EAD. EO has no such clause. Please don't mix the two. H4 EAD was never part of EO and should not be promoted by us in USCIS forums to be so.



Alexelle is right here - somehow there is an interpretation making rounds ( I think it started with the attorney Ron Gotcher) that EO will make this rule redundant. Unfortunately, another rumor doing rounds is USCIS is planning to shelve this admin fix because it is redundant - but as in the example above, this is not the case.

Unfortunately, Indian government is exactly on the opposite side of the table in this issue. Indian IT companies have all along said that passing the SR744 would be detrimental to their business.
