Click on SIIA's ID, you ll be able to see all his posts. This guy is trying his best to misguide people in not signing this petition. You people are mature enough to know that this guy is not one of us. However what's interesting is this is the first time our enemies are trying so hard to not do something. It leads me to believe that this petition might be beneficial if we get to the desired 100k mark. In the past similar petitions haven't helped our cause. But it's different this time. Sign away folks. Instead of posting your comments here for the next couple of days, spend those few minutes creating a new email id to sign the petition. We are onto something this time.

A lot of people are planning on similar lines. The original poster is correct. As per the proposed rule You can get as many h1 extensions as you need until your pd becomes current. If you have a US citizen child, he/she can sponsor you upon turning 21. This used to be plan B for a lot of people but not anymore given the significant retrogression of dates in the bulletin.

After the proposed rule goes into effect (assuming in its current form) unlimited h1 extensions are allowed until the pd becomes current. The only other positive outcome of the proposed rule is the 60 day grace period. Thats it.

Polka, you made some good points abt taking risks earlier but i think you are wrong on the 6 yr cap comment. Pls double check and let us know.

For # 2, EAD, you dont have to maintain h1 b, atleast thats what people were saying before the draft came out. For #1, portability, I agree you do have to maintain h1 b.

I strongly believe we should ask for portability. This way evryone is happy, somewhat! We got nothing so far, if we get portability, which is a possibility, at least that will be better than nothing.

Come to a middle ground, ask for 140 portability so we dont have to restart perm. We will have to maintain h1b though so that lawyers interest is considered. they wont just give us ead as lawyers are going to lose a lot. Mention all this in your comments.

I140 portability is the only likely positive outcome that can come at this stage.

Those who are still asking for EAD + AP, pls wake up. If they give AP that means they have to remove H1b which will never happen. H1b is significant source of income for so many lawyers. Do you think they will pass a law that is in the interest of immigrants at the cost of US citizens? And not just any citizens, lawyers are one of the most influantial groups here.

Conclusion is we are stuck with H1b. In the commenting stage we should ask for i140 portability so we dont have to restart perm when changing jobs. This is the only good benefit that might happen at this stage. Yes we will have to maintain h1b thats the compromise we will have to make.

Keep in mind the proposed rule is termed as retention of employees so the purpose of the rule is to help the employer and not employee. On top of that the new rule will never take away bread and butter (read h1b renewals) of the lawyers. Lawyers are afterall citizens. So When commenting just dont comment something that is in the interest of only the employee. Come up with solutions that keeps benefecial for all 3 parties.

Anyway, please continue to post comments daily. Although the proposed rule is a huge disappointment the commenting period is there for a reason and this is our chance to be heard. I would be surprised if there are any major changes made in the final rule but even if they make small changes in our favor thats still good. Dont forget the two small postive things in the current proposed rule - 60 day grace period if you lose your job on h1 and employer cant revoke 140 petition after 180 days.

When posting comments, try to state your personal experience and hardship that you have to endured bc of the backlog. Specific personal examples are more effective to make your point than just saying we need this or remove something from the proposed rule.

While sending comments is always good but Please dont send the same message again and again. Modify the content a bit every time. Also most of the emails i see here are really long, which is fine but try to summarize and send short emails too. Mix them up. Sometimes people dont read long emails or lose interest pretty soon.

You have a good point but IV is misleading people here. So its important to inform folks who are following IV's twitter campaign which actually is their PR campaign at the cost of jeopardizing H1 EAD. I absolutely don't see the point in tweeting about H4 EAD now. It's done and we have already thanked people responsible for passing the rule. C'mon people put yourself in the lawmakers position and think if you want to keep seeing the same message again and again. Also, what if we overwhelm the lawmakers with the unusually high notes of thank you and they might as well put the whole H1 EAD on the back burner assuming the legal folks are satisfied now?

I have closely followed crespos and zombieman's posts here and simply put they are IV people and have their own propaganda going behind the scene. Please ignore their posts.

We should focus on what's important now, which is getting the H1 EAD rule passed. The H4 EAD twitter campaign is harming our cause.

No not safe to resign. What happens if there is an issue with your LCA and you have already resigned at your current company? Since your company is applying in premium its best to just wait out until approval or at the very minimum until the H1B petition is filed.

Your lawyer may be correct. Even though you are filing under EB2 you may still not qualify. For eg if its your second I-140 filing. There are a few other scenarios where you cant file in PP, which i don't remember but ask your lawyer for the reason.

well, I agree financial is one aspect of I-140, and at the moment that seems to be the weakest in my case and therefore the question. Everything else is pretty solid I just need to know if filing without the 2013 financials will likely result in RFE or not?
