Guys,

Good to see that now everyone is serious about this matter!!

I have send 2 emails, the first one I sent more a year back and now recently. By the way, I have a suggestion to make, it may not be a good idea to send a template email that was shared here, and instead it would be good that you write in your own language. If we cut and copy the same contents they might think we are spamming and might hamper the cause.
This is just my suggestion, it’s up to you to take it or not.

Let us hope this will become a reality soon

I too agree, we should all write to him and show them that there are many ppl waiting for this rule to become a reality! Even though the department or this particular individual may not be able to do anything directly, at least the department will get a good feed back on the support from outside, which can be beneficial.
I have sent the email, guys please do the same. By the way I do not see any reason why we should refrain from writing to him as the email address and contact information is already shared in the website.

Dude, I was reading ur first post and was about to respond and u have another one which I liked :), yes you are correct in the second post. However, I want to tell that unless and until they increase the EB visas or eliminate the per country limit, the movement will be the same as today or may be a bit faster than today as the family won't be counted against the EB visa. The point based system allows only 120,000 visas after 5 years so by the time the ppl wiating will be 500,000 or more in all categories. I am just guessing numbers. Anyways, we are not even sure if this bill pass ;)

Just to reiterate my point again, hope they will implement the H4 EAD rule soon.

After reading the CIR proposal, I think H4 for Indians may not be eligible to work. Currently the Laws in India does allow the spouses to work, which means their visa (X) will not be automatically be eligible for working. Instead it allows the X visa holder to apply for a work visa living in India, if they prove that the spouse is highly skilled and have a job offer of > $25,000 per year. This is equvalent to H4 in US getting a job offer and the employer sponsor for a H1 visa. Why are they make the CIR more complicated as each country has their own visa rules. So far from what I read, this CIR really sucks, as there is no mention on provison to remove the country limits, recapture of unused visas. I hope may be when the real bill is published we will know more, fingers crossed.

Hope they enact this H4 EAD rule ASAP

This is absolutely disappointing that it is going nowhere! I believe the reason for this snag could be complimented to the expected 2013 CIR, but that does not really make any sense as well. CIR is a long process and there is no guarantee that it will pass Senate, even if it does, no one knows how this will be taken up by the House which has a Republican majority.

From the 'Review Extended' status and the definitions it is obvious that this can go indefinitely upon approval from the head and that is what happened to this rule. I have seen many rules in this status with other departments which are sitting for more than 2 years!! Let us hope they understand the need for this soon and make a rule change ASAP so that they hold the Obama Administrations promise made last year Jan for implementing these changes.

Absolutely not possible and the employer has to pay at least the minimum prevailing wage and per the certified LCA on your behalf. Talk to your employer and make sure they pay you as per the approved LCA, otherwise your employer will be screwed if an audit comes.

Only when the CO determines that his/her Denial is correct will your case be forwarded to BALCA, so you would not see your Name or case at the above link until it is moved there by CO.

Unfortunately there is no place that I know of that maintains the processing dates for BALCA cases. As your attorney said, some times the CO may misinterpret, my case was also denied similar to yours, hopefully your case will be approved by BALCA soon. Can you check with your attorney, may be he/she can answer this.

To my knowledge I believe your cases was not considered under the Reconsideration Queue or "Govt error Queue" by the CO, and hence it was forwarded to BALCA for further processing.

By the way, do you know why your case was denied?

Friends, does any one have their PERM denied and appealed with Aug-2011 PD, please post your current status. I am still waiting for a response from DOL, and the waiting is seems endless.
