Topic: EAD for H4 Visa Holders

Lets not divert this topic to being greedy or not. Everyone has a story! I would like my spouse apply for EAD if there is an opportunity, that way she has the flexibility of moving, in case my next projects move to different locations. So, my question to the forum was straight! If the H1 to H4 application is approved first, does my spouse have to stop working on current H1 and wait until the EAD is approved OR can he/she continue working on the current H-1B?

Me and my wife both are on H-1Bs and my I-140 was approved. I see that my wife can apply for Change of Status (COS) and EAD at the same time. But, considering the time frames for approving these two applications (lets say 2 months for H-1B to H-4 and 90 days for H-4 to EAD) what happens when she gets her H-4 approved first? Does she have to quit the current job and wait until her EAD gets approved? Any thoughts???

I have the same question. Can the spouse send applications for (1) Change of Status (COS) from H-1B to H-4 (2) H-4 to EAD at the same time? Please let me know if you find answers for this. I am worried, what if USCIS accepts h1 to h4 but EAD takes, lets say, couple of months.... does the spouse have to stop working for his/her current employer for this period???

What if both wife and husband are currently on h-1b visa and one of them has I-140 approved? When this rule comes in effect and if the other person wants EAD does he/she have to apply for H4 and EAD simultaneously? What should be the line of action in this kind of situation?
