I am in same boat as you. 10+ years experience, MS in CS, level 4 wage, got specialty occupation RFE. If you are from CS background, it will be easy to provide this. You can add things like algorithms, datastructures, networking etc as required knowledge for various job duties, and then link to courses from your transcripts

There is certainly a chance of an educational RFE if you are from non-CS. There are plenty of cases on trackitt recently like this. If you have the necessary docs, you don't have to worry about it. What you need is have a credential evaluation to prove that combining your education and experience is equivalent to a bachelors in CS. If you already have that, you are probably good to go.

I received a similar RFE for Software developer role and level 4 wage although I had MS in CS. You need to prove 3 things to effectively address this RFE -

1. Prove that your product is complex - Give detailed description of the product and explain its complexity
2. Give detailed description of job duties, and describe them in a way, that they seem closely tied to skills one acquires by doing Bachelors in CS. For example, if the duty is "writing code" - you can describe it as "writing good code using efficient algorithms and datastructures" and other things like good oops design, database design etc.
3. Tie the skills required on the job to your academic courses. Like in case of above job duty you can easily tied it to Algorithms courses.

If you have a non-CS background, although they did not ask in this rfe, it is likely they may issue a second RFE for educational background. So, its better if your attorney addresses that part as well now itself, without causing unnecessary delay again. You can probably prove this using experience letters instead of academics

Sorry to hear about your case. It sounds almost impossible that your petition got denied. From what I gather you are in 1132 SOC code with level 4 wage. If this can get denied, then pretty much everyone in silicon valley can be sent home. Could you please shed more details on the reason for denial, so that all of us don't freak out? Greg is full of shit. He's just trying to fan up conspiracy theories to cover his butt. Theres no f-ing way 30k visas are available to eb2 India and China. It has never happened in the last 10 years. The reality is there is just too much demand for eb2 due to porting/dependents and very less supply.

When the STEM-OPT rule becomes NPRM this month, we should run a campaign to make sure to write comments to trash it.

That rule is going to make backlogs much worse by enabling ROW folks to file to i1485 while on OPT. This rule only encourages more temporary slave labor for everybody else, and employers are big time for it.

Law suite is not about if the visa no's are available or not. USCIS published a VB with certain dates and then changed them, a lot of people spend a lot of money based on VB1. So the law suite is for either to roll back the VB or pay the damages.



Yes, its mostly about money. But I bet most people don't care so much about 200 or 400 they spent for medical expenses for them to go and sue USCIS like this. They are doing this because they are believing whatever Greg is saying that USCIS broke some law and the VB will be taken back if they sue. The only winner in this exercise that I see is Greg himself.

Guys, don't fall for this bogus lawsuit. Greg siskind is only trying to make a name for himself and not acting in interest of the general EB community.

While the government is wrong to change the visa bulletin midway, causing unnecessary expenses to folks, the law is on their side. The law clearly states that you can file I485 only when visa numbers are available. Its very obvious that there are no visa numbers available for giving green cards to folks from 2011 by next year. I am sure 99 percent of you agree with this statement.

Greg is trying to sell snake oil by saying law is on our side, when clearly its not. Maximum government can do is to maybe refund some of the expenses folks have spent, but not change the bulletin for that. Also by suing the government, all the goodwill that is created is being lost, which may affect other reforms in the pipeline



The creation of a separate category called "acceptance dates" is solely based on the fact that there are not enough visas available for EB2-I and C and hence provide some relief in the form of EAD/AP. So the question of visa availability does not arise for the category of "acceptance dates". Nowhere in the bulletins USCIS said that the people applying under acceptance dates will get GC within certain timeframe..

Whatever you have against Greg, at least he is doing something. What have you done?



I don't have anything against Greg. I am just trying look at this lawsuit from an objective standpoint. The creation of acceptance dates does not change much. USCIS and DOS still have to follow the law that one can only file 485 when visa numbers are immediately available. From the lawsuit response, it seems USCIS/DOS has defined immediately available as next one year. So that is the logic behind that. They cannot move the date to 2011 unless by next year, people with 2011 PD will be given GC.
