Waiting until approval and then re-enter in GC status (maybe with copy of approval) notice might have worked too.



So, in this case, I-485 is not abandoned even though the H-4 dependent technically loses its H-4 status?

Technically she was out of status for the 30 days you were no longer in H1 status, and she also entered the US in invalid status. That you knew about it makes it even worse (intentional fraud vs unintentional mistake). Lets hope they don't figure this out during your citizenship application. You should always get AP when you travel. You don't have to use it (entering on H is much easier), but it protects against this kind of situation.



What then would be the solution in this situation, other than AP? Can one apply for the "follow-to-join" if the H-4 dependent stays out of the country?

Glad to know that it worked out for you and your spouse.

We will be in Korea for about two months from later this week, but once again, since we have yet to get FP done, we hope the scary situation won't happen to us.

So, here is the hypothetical situation.

1. Traveling abroad using valid H-1B and H-4 visa stamps in passports. (no AP approval)

2. only H-1B holder (primary 485 petitioner) gets GC while traveling.

3. What happens to the H-4 visa holder, who obviously does not have AP docs and stays abroad?

Since I don't have my FP yet, I don't think I will get approval while I am abroad, but I am just curious what would happen in this situation.

Topic: Infopass experience - as to FP notice

I had an infopass appointment today at San Antonio office. Basically, I went there to ask whether I can have FP done before I travel out of country for two months from early May. The officer there told me that there's no way he can schedule a FP, because it's done by another company. He basically told me that I should wait it out, and I will have three months to reschedule from the initial appointment date.

One thing he told me though was that my security check was cleared--it was requested on 3/25 and came clean on 4/1, although my spouse's security check is still pending.

Has anyone been successful in getting a FP appointment/scheduling through Infopass? I found some previous examples at other Immigrationportal.com, but they were somewhat dated. Any new update? Thanks.
