Yes I had my 2nd fingerprinting done but apparently they did not go though so I had a 3rd one done and a 4th one done. The 3rd was also code 2 the 4th was code 1. It was a routine process.

Topic: Can I sue (writt of Mandamus) my local office?

I would contact the USCIS Ombudsman office before wasting money on a lawsuit. I was in a similar situation until I sent a letter to the Ombudsman "DHS Form 7001". About 1 month later I got approved. I sent the letter on June 13th and I was approved on July 22nd. Once my complaint to the Ombudsman went through an IO was assigned to the case. The IO even called me to verify that I went for a second fingerprinting.

I have tried service requests, contacted senator, congressman sent faxes to the service center none was able to help but the Ombudsman did.

It was at TSC. It was originally at VSC but back in 2005 USCIS transferred it to TSC.

Today my LUD changed to "Card Ordered", I am glad it is over. It only took 1558 days, 5 EAD's, 5 Travel paroles, 4 fingerprinting visits, letters to Congressman, Senator, FBI, TSC and Ombudsman.

Topic: HELP!! Biometrics Frustration

My first biometrics were taken in 2005 (I-485 case pending since 2004) about one month ago I got a request from USCIS for biometrics code 2. I went to a USCIS office and got them taken in June. This past Thursday I got a phone call from a USCIS immigration officer asking me if I received the request to go get biometrics taken and I replied yes and I had them done in June for some reason it did not appear on USCIS database (By the way I sent a complaint to the USCIS Ombudsman office on June 13th about my case and I guess it made its way to an IO).

When I got home on Thursday there was a letter in the mail requesting that I go to the USCIS local office on July 9th for biometrics code 2 I guess this must be the request the IO was calling about. Today I got yet another request for biometrics to be done on July 10th this time code 1. This makes it three biometrics appointments in less than one month.

I called my lawyer and he has no idea what is going on he seems more confused than I am. Has anyone else experienced such a thing?

Topic: Case Transfered to Another Office for Processing

The status on the 1-800 number has not changed since March 15, 2007 when the application was transferred to TSC. This I-485 application has been pending for more than 4 years. I have no criminal record, no DUI not even a parking ticket and I have been living in the US since 1993 (F1 visas from 1993 until 2001, H1B from 2001 to 2004 and pending I-485 ever since). For some weird reason USCIS keeps postponing my case.

I have not received any updates or notices indicating where it was transferred too. My lawyer is suspecting it was sent to a local office so they can interview me which I find a little bit odd since this is an EB2 based application.

I got my Biometrics code 2 done today. Couple of hours later CRIS updated the status to:Case Transfered to Another Office for Processing. The case is still at TSC. Why would they transfer it to another office inside TSC? I had a transfer from VSC to TSC back in March 2007. This does not make sense to me. Why would they transfer the case again and only two hours after completing biometrics?

I received a letter today from USCIS to go get my biometrics (Code 2) taken. My I-485 case has been stuck in background check since the first fingerprinting in 2005. Does this mean my background check is complete? Does code 2 has any significance on how long it will take before the I-485 application is approved?

Topic: How to write a letter to a senator/congressman.

I am in the same situation. I just sent a letter to the Ombudsman today I hope it goes through. I previously contacted a Senator and his office sent a fax to USCIS. The response from USCIS "Case pending due to outside processing" I get the same response every time I contact them.

I was told by the local USCIS office to write a letter to the Texas Service Center where my application is pending. Have anyone tried this?
