Topic: reentry with AP

According to my attorney, you can NOT leave the country before your AP gets approved (to be able to use your AP for re-entry), but once you see the approval online, it's OK to leave the country and ask somebody to send the paper to you before you come back, then it will be no problem.

The date of approval is important, so the Immigration Officer at the airport sees the computer and finds it out. Of course, each attorney has different opinions, also maybe it depends on the IO at the airport, I am not sure which one is correct, but I didn't want to take any risks, so I waited until I actually got my AP in hand.

Mine was paper filing, but similar situation (RD 6/18@TSC). Got only 8/12 soft LUD, nothing since then.

Topic: Is it safe to travell on AP while your I485 is pending.

I just came back with my AP from outside US. I had only my passport and AP. You just need to fill out an I-94 + Customs Declaration Form as usual (you can get them on the airplane or at the airport), that's all. No problem.

You are so right! It 's not fair at all, but I didn't contact USCIS and just waited because I didn't know what to do or whom to contact since that was my first year in the US. Now, I highly recommend you call USCIS to find out if your spouse don't get the DL soon.
