Hi,

Can you please tell me what is interfile.

My first I 140 approved in 2007 (prioirty date June 2nd). 2014 started EB2 process and 2015 perm approved.
Submitted I 140 under premium process and EB2 approved I 140 shows old priority date. Submitted I 485 end of August,2015. But I am not sure when we need interfile how to do it, please guide me.

Hi,

I am pretty new for this. And my question is very basic scenario.

Example
Assume that in August current priorty cut off date is July 2007
Mr. A (Jan 2007 priority date) filed 485 on August 5th
MR. B (Feb 2005 priority date) filed 485 on August 25th

In September Visa bulitin Cut off date moved to May 2006(retrogress).

Question is Mr. B application will be processed first or it will be processed in the same order they received the application.
I like to know only what is order of processing application. I know Mr.B cannot get GC even his application approved.

When I say internal project. Some companies will be doing products. When resource come out of project they use them for their own product development. Once they got some client requirement they move the resource to client place. The employer make money when they work on client place for that I called real job.

Converting into B2 visitor visa coming back to H1 cause lot of issue. But I heard some one will join as student visa and convert back to H1. This is also complex process you can done only with attorney guidance.

I agree with JoeF18. The process I mentioned if things are getting worst then only. Other wise always it is best what you mentioned. In reality find a new project will take at least 2 weeks time (Its holiday time and new budgets will get active by end of January so it takes more time) as per the process the employer have to file and LCA in client place for 2 weeks get it signed by client office assistant then apply for LCA this will take 7-10 days then only can file H1 B transfer. All together will take around 1 to 1.5 months assume everything happens continuously. If it is a big company internal communication approval process will take some more time.

I gone through the same pain last year.

1. Request your current employer to hold for little time.
2. Try to approach all vendors and get some job. If you get big vendors all the time they will have ready made LCA all they have to file your H1b extension.
3. Generally you have around one month time because our pay stubs will be running minimum 15 days late like and you have 15 days for next pay stub it means you have one month time.
4. In worst case find some desi consulting company who can file by using internal project and regular H1 transfer process, by the time you get query it takes 3 to 4 months time by that time you can get some project and file amendment.

Topic: FOIA to get I-140 information

I got from G369 2 yrs ago for I 140 and a year ago my H1 petition as well. The only thing they will not provide a original copy. They will send you a CD with a PDF document. In case of I 140 they provided the original application submitted by employer on top a stamp shows it is approved and A#.

Make sure you notarize the document before you send the request other wise they will send a letter to get it notarized.

You are suppose to send the application to below address.
Natinal Records Center (NRC)
FOIA/PA office,
P.O.Box 648010, Lee's Summit, MO.....
