The problem though is that the H1B quota for FY2009 is full (and so is FY2008), for both the regular category and the category for persons with a US Masters degree. Unless you are excempt because you have previously held H1B status or if you can use the Singapore/Chile quota (have to be a citizen of one of those two countries), the earliest date your H1-B can be valid from is October 1, 2009. Ask your lawyer how he/she thinks you can get a H1B faster than the AP. To me, it sems your best bet is to request the USCIS to expedite your AP because of your sisters wedding, but I am no lawyer.
Ask your lawyer again about this, and if you don't get good answers, consider changing lawyers. Not all lawyers are good lawyers. |
