| Changing from EB3 to EB2 |

The process is... file new i-140 as an amendment to the first one submitted. USCIS would have to find your first i-140 file and detach original LC, which in turn will be used for the secondly-filed i-140.
I went through this. But in my case, it was from EB2 to EB3. My attorneys filed me as EB2. After I advised them, when it comes down to the wire, that I did not have 2 months to have full 5 yrs of experience (4 yrs and 10 mos) to qualify for EB2, then they decided to re-file. They filed things on my behalf without sharing any docs or copies. The only way how I learned that they filed me as EB2 is when they asked me to do medical exams and get ready to file 485. |
