Consulates give passports whether you are in status or not. The purpose of a passport if for travel. I know mine does. and the stamp has a special ink that cannot be replicated. The stamp will not be placed on anything but a passport.

Italian consulates in the US issue a new passport (or renew an old one) to italian citiizens if and only if you have a valid status in the US. If you do not have GC, applied for it (i-485) or a dual intent VISA (like H1) they keep questioning why you ask for a Italian document abroad and not in Italy (meaning with F1 or J1 it is a lot harder to get the Italian consulate to work for you).
