I-485 Interview - IO took our I-94 |

Hi All
pls let me know if you have gone thru this same situation.
we had our I485 interview last week, here is how it went -
- me and my husband reached half hour before the interview
- we were then invited to come onto the IOs office where they asked us to swear in
- the first thing he asked is a form of ID, we gave our DL and Indian Passport
- he started taking off our I-94 and then stapled it to his file, at which point i immediately told him that since my i-94 is expiring in november I will be taking an infopass appointment after the interview to renew it. at this he smiled and said - you wouldn't be needing that. this was surprising, then i said that what if we have to travel, what do we use at that point. so he said that the I-94 is not needed to stay in US, only when you travel. he asked us if we will be traveling before november and we said NO and he said that new numbers should be in the system on october 1st.
- then he took our employer letter pay stubs and tax return and asked us the NO questions to which answer was all NO
- the IO was very cordial, asked us very few questions and was just chitchatting with us
- then he said - all our paper work is in order and I have all I need from you and we are good to go
- next we left the room very confused without the I-94
My question is
- What do we do now since we dont have our I-94. will they send us a new I-94 or is there something else that we will use as a substitute to I-94. what do we do if we need to travel. our priority dates are sept 2004 EB3.

Hi Priya ,
Myself & my family ( wife 2 kids ) had exactly same experience on 09/03 in Newark NJ AOS interview!. My priority date is Oct 2003 EB 3. Only she didnt say very clearly that numbers would be available in Oct.09 , but advised us NOT to travel outside US. But hinted in Oct status might change.
Then checked with some other officer & just while we were leaving again saw our passports & said as your H1 & H4s ( me & family) are valid you can travel & come back on same visa.
I asked we need to go to India in Sept , then she said you dont need to surrender I 94s as it will be in the Airport computer system that USCIS has taken your I 94s ??
Even i am confused ..

Even our situation is same. The Officer just took Primary i-94 during the interview. we r travelling this Friday to India thru Dallas. i had just been to infopass appt today..and again officer said we dont need i-94 as long i have valid AP and valid Passport/EAD. I consulted my lawyer also she said we should be fine. Just to mention that my i94 is with officer and show them copy of appt/i-94 etc.

well my problem is that my i94 is expiring soon and so i have 2 worries
1 - dont have my original i94
2 - i94 expiring

Would you please update your status on the I-485 interview and current status on your AOS?
We too had the same situation. IO tool all our I-94s and she mentioned that once our finger printing is cleared they will approve our cases. I am surprised. Our PD is not current as well. Did you hear anything from IO or any case status change.
Please update. Appreciate your inputs and updates.

I had my interview .... officer said everything looked fine.
but he didn't take my I-94. I am surprised to learn they did take I-94's from some people.

this is normally a good indication. i/o said u would not need because you will get ur gc soon. i94 and any visa cancellation may be part of gc issual of gc.

IO also took our I-94, & he was Ok with the interview. after that they gave us a letter saying: Your case has been adjudicated" If you dont hear in 180 days from us,pls feel free to call & enquire. What happened to your I-485 interview; did they get your GC; or did you schedule an InfoPass to find out what is going on? Also what did you decide about IO taking your I-94s? I am also in the same boat; and I am not even seeing any LUDs at all. And I am confused and worried. Please provide your inputs and feedback.

Do you have a copy of I94. YOu need that to apply for Extension of Stay. Always take the copy of I94 before the interview. If they take it, ask for a copy and explain him that you need it for extension in case there is a delay.

I am also in the same situation - Interveiw was on Oct 29th, and IO took all our families I-94 and said that there is visa numbers available and you would hear from us in 4 to 6 weeks. I was surprised; told her that our dates are not current; and she did say that your case if filed in 2005 and we do have visa numbers available. Now all of us are without I-94. And not a single word / update / SLUDs on our case. The new visa bulleting also not moved the dates - very confusing. I am thinking to wait for 2 more weeks and take an InfoPass to get our I-94s back. Please advice your situation if same and what your action plans are... Appreciate it

Do you have a copy of the I94 ?. if not you have to go much earlier than that before they transfer the file somewhere else
I will apply for the extension, which due by march '10, may be by Feb.
Till they approve and send the notice, keep yourself in H1b

I am having priority date aug 2006, IO officer gave us one letter also stating that "Case has been adjudicated" if you dont hear us within 180 days.. you can call us. I dont know after that I didnt have and LUD or any updates.. Myself/family interview was in july 2009. Pls keep me in the loop if you hear something and if I hear something I will update you....

Hi,
We had a similar situation. Last entry I 194 (EXPIRED in 2005) which was stapled to the Passport was taken by the IO.
We still have the new I 94 from the H1B approval Notice.
Can we use this I 194 to exit when exiting US for travel.

Just finished our interview. Nothing was asked really just a quick section of "facts verifying"
I gave my latest paystubs, EVL etc.. thats it
The IO took our I-94s and gave a letter which checks a check box: your case will be continued..
I am not sure what does this mean

Did VO not ask for tax returns or all the pay stubs for prior years?

If you see my profile, I have already attended once for the AOS interview last year. At that time the interview was in details(see my profile for full description). This time they called for another round of interview (after an RFE and reply in late 2009).
The IO said that the interview is for "Facts checking", a crappy word for a time waste interview call.
The IO asked me to give ALL the papers, I told him that I have already submitted a truck load of papers to them, what exactly that they want. He answered nothing. I myself gave him the latest pay stubs, latest w2 copy etc and ask him to have fun.
I am fed off with this bugging of interviews and RFEs for ages...

2. I have I-140 under EB2 approved with same employer. Approval notice of EB2 I-140 is having PD same as EB3 ie Dec,2003 (this I-140 is approved in Oct,08 and actual PD as per LC is Feb,05)
3. I believe my EB3 pd is moved to EB2.
My question is should I go for Interfiling or File new I-485 under EB2. ( skills are same for both EB3 and EB2 "Java").
I am OK with W2 and pay stubs for the last 6 yrs.
Please let me know your opinion.

One good thing on your new EB2 approval is that you got the old PD on the EB2 i140.
I guess your new EB2 i`40 approval notice shows your A# on the EB3 approval.
1) Call USCIS and ask them if your new EB2 is in the same file as your existing AOS petition.
2) If not, ask them to merge all your petitions and approvals since those are for the same A#.
3) Also write a polite and simple letter to USCIS with all of your old and new EB approvals(numbers and copies of them) to use your EB2 approval as per the Pearson Memo (check trackitt for the link of this memo, I posted the link on one of the threads). (also attach a copy of this memo with your letter).
4) After a month or so, again call USCIS and check as per the step (1)
