I would say so based on last 3 months of data, but its not true. You need to wait for another 2-3 weeks for December 2008 cases.
Remember DOLs' press release, they said that, they got 20,000 PERM applications in last quarter of 2008. You need to consider that data for your analysis. If you consider that number, in practicality, it might be little longer than expected. Also memorial day is coming next, Hang in there guys it will come for sure but little late.

I never said they were working efficiently, I said that if they want to work efficiently they will move on to Dec 2008 cases. The point here is that we all know they have not even finished completely with the previous months cases before moving on. So with all the tension that some people are experiencing right now, and I do understand; it will not be rare to see that the DOL start working on cases from Dec 2008.

Someday they will finish with all cases. So far I think they are delaying cases because they do not have enough workers or they have a pre-established numbers of cases available to approve....

They did a great job on Sep'08 (+70% cases reviewed), Oct'08 (+65% cases reviewed) and Nov2008 (+55% cases reviwed)...but Dec has not started yet on Trackitt -- The previous trend HERE showed that when DoL reachs 40% they start the next month...I'm afraid DoL will start slowing down again.

I have a friend with priority date as 12/3/2008 and his case was certified yesterday---- he doesn't want to add it on trackitt for other reasons though. Well, now it's really coming soon. Good luck all !

What I saw from the tracker is there are more audit cases getting approved and I think they are focusing more or audit cases but it does not mean they will not process Dec cases untill every thing is cleared.

Guys please be cautions when you are putting information like this as i can raise expectation for so many people waiting for their PERM getting approved with Dec 2008 PD.
I have seen to members saying there friend’s cases got approved with PD of 12/2/2008 and 12/3/2008.
I request you to please re-verify with your friends, as this is not a joke for many of us.
Please post once again once you verify and convence those people to add their cases to trackitt as it would be helpful for a lot of people.

Good point, but my question is if DOL has been really following cases by month. If they are then it makes sense, If not then the last case I have seen approved on trackit is from 11/29 which is 2 days away from December. Anyone can predict that December will be starting soon just matter of few days.

Do you know the difference of sample and population? Trackitt represents less than 1% of the DOL Perm cases -- yep, you can do the math based on the cases DOL reports on their website and the cases added here (quarter by quarter if you want). Do you know where are the other 99% of the cases....I don't.
I have at least 17 coworkers in my company that have applied for PERM and the only case added to Trackitt is mine. BTW, 30% of them are being audited (almost all filled in Nov/08).
I'm trying to raise nobody's expectation, I'm just communicating the one fact I know. All in all, I agree let's discuss our cases here and nothing else.

I remember doing the calculation 1-2 months back, and finding a larger number (2.5% which is quite impressive). I had used the same strategy, that is the number of processed cases on Trackitt (approved/audited/denied) over the number of cases processes as announced by DOL.

Trackitt audit rate seems a little lower these days. Does your company use a reputable law firm, or are you on your own? I understand that if one pays out of his pocket, she wants to save costs. It does not make sense to me that an employee would have to pay for the fees, since the employer certifies he could not hire any one else (it even makes even less sense if one is seating on the bench but I digress)
Some observations many may have also made:
1) DOL slowed down the past few weeks. Maybe because of the review of the contractor work as DOL had warned back in January
2) No current December 08 case reported on trackitt (except a friend or two). How would a single case approval indicate anything about someone else's case (one could argue that because one case was approved, there is more chance that the following ones will be audited, so keep cool)
3) A few audit approvals the past few days.
4) Despite the recent slowdown, over 175 cases were approved/rejected in May. Not bad.

I am so unlucky man. My first LC filed september, 2007, which was audited. While I was waiting, I moved to a new company. But, my h1-b transfer is pending for 15months because of name check. After I noticed that I was stuck with FBI name check, I applied for LC again. What I was thinking is that I can bypass h1b namecheck applying for Work permit once I got the LC approved. But, my LC, filed Dec 10, 2008, is still pending, too. why does DOL come back to slow mode? On september 30, my driver license will be expired and I will not be able to renew it if my h1b is pending, and LC get audited again. Why is my life so gloomy? I am getting mad. Please, help me with your kind words.

There have not been a real move for Dec 2008 cases, because I see a lot of work in cases that have been audited in 2007 or cases from previous months that had not been resolved yet. Just be patient ...

I have been trying to find a case in any website approved from December 2008 and I have not found a single one .... You are right it is very unpredictable to have a frametime at this moment ... Also, DOL has not published any information or stats about the 2nd quarter of the 2009 fiscal year as they did with the 1st quarter. In fact, they removed the 1st quarter report that they published from the website about a month ago and they did not published the 2nd quarter...

There are a total of 1344 cases pending as of now
Out of these 1344 cases 578 cases have recived audit
Which makes 766 cases pending which are untouched.
Out of those 766 untouched cases 363 are filed before Dec 2008.
looking at those 363 cases, about 75 cases have not been updates for last 3 months.
I am assuming atleast 50-60 of those cases that are not updates for more than 3 moths are already approved.
Which makes a total of amout 300 -325 cases pending that have PD before Dec 2008 and haven't recived any decision or audit.
With the current pace of DOL, I am assuming DOL will take another 6-8 weeks to clear all backlog.
At the same time I don't think DOL will wait to clear all backlog before moving forward with Dec 2008 and later cases.
So, if DOL is not planning to slow down once again like they were 3-4 month ago, we should start seeing Dec 2008 approvals by late June latest.
At the same time, we know the PERM filing rate have significantly dropped and we have 403 cases pending with PD Dec 2008 or later which is going to grow but not too much, I belive, very soon (Next 2-3 Months) we will see PERM getting approved in 60-90 days.

I agree with you in almost 90% of the analysis how ever as you know DOL takes pride in non-predictability you never know whats next.
