Just to make this wait less miserable- i have created March 09 "support group". Any thoughts when you think March cases will start to come?
to gcwaiting2009:
No point in guessing, YOu need at least 9 months to get process according to DOL. So they should start reviewing at least by Jan 1st of 2010.
You may see some approvals for March before Christmas!
to william689:
There are still people who waiting for January 2009.I seen couple of February approval that is good news. But I think March have to wait until
15 th Jan 2010.My application is March 18th.
to sam70:
Maybe! My case is March 19th. Send me a message when your approved :).
I hope march will start before Christmas, cause Feb has less apps than Jan, so Feb should be processed faster.
I am March 13.
Mine is March 5th.
I hope we can see approvals before Christmas.
How many days does DOL take off during Christmas?
to mbayrakdar:
Mine is March 09th, Waiting for the approval. Hope DOL start processing March 09 cases soon before christmas.
to gcwaiting2009:
Eventhough DOL is processing Feb 2009. I still see couple of people from January waiting. So I hope March will strat around January and completed by January end.
Thanks,
Sam70

to sam70:
As I said in the above post, it will definitely start in jan 2010. Even though DOL doesn't take many holidays, many employees will go on holidays, thats American tradition. It will definitely take more time. It doesn't matter how many less cases we have for Feb 09. Its around 150 cases according to trackitt. If we are lucky, you might see one or two cases, but its optimistic saying.
C'MOOOOOOON DOL :) 31% for Feb
The first March approval is in!
to mbayrakdar:
It appears that it is not a true March 2009 case. I checked his previous responses. In one of his responses, he said that he applied for PERM before Feb-05th 2009.
to mbayrakdar:
No way, its a false alarm. I don't believe its a 1st march approval. Still we are not done with Feb 2009.
I see Feb to be 48% complete, so guess March will start tomorrow most probably :)
to willgetgc2025:
First March 2009 case has been reported. It is a good news.
Now the real waiting begins.
Hate this shit, I guess it's gonna be more difficult to live through this month than through previous ten. Unless you are approved early.
are they still in holiday?
to mbayrakdar:
Mine is March 5th too...
We'll see how that goes !
to sid6581:
Still waiting for Feb 15th case. Attorney says, still DOL is working on FEB 2009 cases
to gc4tiger:
It looks like we have 3 to 4 March approval yesterday. DOL has started processing March for sure.
to sam70:
Looks like it, but still there are people who didn't get any response to Jan, Feb months applications. Hopefully they get some status. I still think, they are on Feb 09 as we didn't see many cases. We need at least 10 cases to believe March as started. Waiting for today's approvals.
to gc4tiger:
Mine was Filed March 16, 2009... can't wait..
PD March 31 2009.
Hoping for the good news.
Mine is March 1st. Nothing for me yet.
to Axlrose:
mine march 4th.. lawer says pending.. he said they are still working on jan cases.. so not sure how 9 march cases approved.
good news i got 1 yr h1 extension so can stay in country till mar 2011.
to kedar801:
How does that work for the 1 yr h1 extension ? Is it expensive and is it fast to obtain ( I have been here almost 6 years )
to sid6581:
fortunately my lawer n company did it for me so i haven;t paid single penny.. but looks like it's pretty simple process same as 3 yr extn.. and they have premium processing option as well but it will be expensive..
i think you should start ur extn before expiring ur i797.
to kedar801:
I have seen couple of March labour approval. Please update if your case has been approved. Mine is March 18th.

to sam70:

to green4indian:
Seems to me DOL is working on EB2 at the moment. EB3 will have to wait a little while longer.
to ProBono:
I am seeing no audits at all since Dec 22nd. Either people are not updating their cases when they get audits or it is a really good sign. Any Inputs?
to ProBono:
At perm stage, there is no EB2 or EB3, it only matters when you filed it. Thats what matters.
Looks like march 09 game is on. iCert portal's Processing times updated to Mar '09 cases....
Good luck to all of us.
to gc4tiger:
gc4tiger, what does it mean exactly what you said? At PERM stage there is no EB2/EB3? Would you please explain. Thanks,
The first EB3 approval is in.
Nobody is filing EB3 anymore.
to Ahmed:
Basically, at perm stage, you only file with required qualification and experience thats what matter for DOL to approve it. Of course you should make sure that, qualification and experience goes into what ever the category you wanted (EB2 OR EB3).
My only point is that, for approving the PERM by DOL you don't need to mention its Eb2 or Eb3, they won't consider whether your application is from EB2 or EB3. This is a labor certification, which only says that, employer couldn't find a specified skilled worker in that area with required skill set and experience.
EB2/EB3 is at a later stage, probably its at I485. Thats where they consider your category as they assign GC. As for as I see perm application there is no mentioning of the category.
to gc4tiger:
485 is just adjustment of status. You have to mention the classification at the PERM stage. 140 is the final stage where USCIS makes the decision if the case falls under EB2 or EB3.
to Ahmed:
As for as I know in the perm application, there is no mentioning about EB2 or EB3. I saw the filled up application when my attorney was filing. Probably it may be at the stage of I140. If you go and see http://www.foreignlaborcert.doleta.gov/pdf/9... this application. which is used to submit the perm application. You don't see it in it. where do you specify it? Do you know any other place. I am not aware of it.
to gc4tiger:
Officially DOL is processing March 2009 cases. Its mentioned on their website.
http://icert.doleta.gov/ go there and click on perm processing times.
to gc4tiger:
March approval is moving further at slow pace. Mine is March 18. Is there anyone who is around March 18 . Please post your status.
to sam70:
Hi guys, my boss just received the following e-mail from the government.
I am not sure on how to interpret it but it looks like it has been approved.
Do you have any idea on how quick I will receive the actual paper ?
What are the next steps after this ?
This is only a courtesy email notification that the ETA Form 9089 - Application for Permanent Employment Certification for XXXXXXXXXXXXX sponsoring YYYYYYYYYYYYYYYYY for the full time position of ZZZZZZZZZZZZZZZZZZ (case number .............) has been reviewed by the Certifying Officer and will be certified.
A formal certification letter will be sent to you and, where applicable, to your authorized agent via U.S. mail. If an agent or attorney is listed in section E of the application, the certified ETA Form 9089 will be sent to the agent or attorney, if no agent or attorney is listed, the certification will be sent to you. Please look for this correspondence during the next few weeks.
Important Notice: This e-mail does not provide evidence of certification for support of the USCIS I-140 or any other form or program. USCIS will deny a petition that uses a copy of this e-mail rather than a certified ETA Form 9089. They will not request a duplicate based upon this e-mail.
to sid6581:
Congrats Man, Your PERM has been certified.
to gc4tiger:
Thanks !
So, I am not sure if I should wait for the official paper to arrive to update my status on this website (since it could takes a few weeks from now to receive the letter and to go to the next step...) ??
to sid6581:
Congrates. I am sure your attorney will get paper in two week .
DOL processes march in slow pace. Seems like they wanna keep 10 month processing timeframe despite the lower number of applicants. Not much improvement with audit processing either. Lazy and evil organization.
to Bilka:
Just to let you know, my priority date was march the 5th. So yeah, 10 months and a week ...
My friend did PERM when it just came out a few years ago and it took less than 2 months to get it !!
to sid6581:
One of my friends submitted his Perm in early 2007 and got it approved within 3 weeks. He didn't even notice the waiting and is so surprized that it takes so much nowadays.
to sam70:
my PD is Mar 17th and got a call from my HR earlier this week only about the approval..so, i guess you'll be getting soon.
Good luck sam70.
