H1b Ext Denied at CSC

Hi all,

My Ext got denied this Friday .. applied on Jan 24th at CSC

Wage - 2
Role - Programmer /developer 2


My current employer A asked me to leave the country in 2 weeks since my extension denied.

But Employer B ready to file my visa transfer/ext this week and they asked me to join by March 5th, so may i resign from Employer A once after getting receipt number from Empl - B ? so that i will server US notice period of 15days

if am not resigning here in the US , I cant join Employer - b in few weeks because if i resign in india i have to serve 3 months notice period.

Will I travel back to India and do my stamping once employer - b case gets approved and join employer - b ?

In worst case if my H1b transfer also rejected what confrmation i need get from Employer - b to work in offshore with Employer - B ?

Please advice

Well, first of all sorry about your denial. Your denial of H1 extension will be effective since the last date of your H1 passed, so it will be retroactive. Even if your Employer B xfer peition gets approved, you might not get an extension of stay, which means you will have to leave the country, get stamping and re-enter. If employer B xfer is also denied,then there is no way you can stay here. To work offshore with employer B, I don't think you need anything, since you will be an India-based employee anyway. If employer B filed xfer now, but you leave to India, then yes you can go for stamping using he approved petition.
