Hi All, I am trying to help out an employee who just had an H1B denied, he's been here a couple of years
and has a girlfriend he intends to marry - he is out of status on Feb 14th, does he have time to apply for
a fiance visa and not have to leave the US?? If he files the application he's legal to stay right? ANy ideas
when he would be legal to work again??? (we don't want to lose him as an employee!!) Thanks

Fiance visa can only be issued outside the US. His only option is getting married, then he can get an EAD within 90 days assuming everything else is in order.
