I am facing 'send now' or 'send later' dilemma! I married a USC in September and getting ready to send my I485/I130/I765 and I131 out. I am currently holding a valid H1B visa (with valid stamp). I am going out of the country for my brother's wedding in Malaysia on November 13th and come back to the US on November 29th. I also got an offer (verbal offer) from a company who wants me to start workign as soon as possible. My question is shall I turn in my AOS package now? or wait till I come back from Malaysia at the end of November? In this financial uncertainty time, I am anxious to get a better paying job soon but don't want to jeorpadize my application status. Can anyone who had the similar experience advise me on the best practice? Thanks so much.

I had the same dilema as you before I filed my application. I talk to an immigration lawyer and was told that I am MOST LIKELY not be permitted back into the US if I leave. I was spefically to "what ever happens "DO NOT LEAVE THE US" not even going to Canada bty road which is just a hour away from me.
As soon as you put in you AOS application you have indicated a willingness to immigrate and so you can only leave an return with a special premission called "Advance Parole" if you do not have that you not be allowed back.
You can travel on you H1B visa and start the AOS application once you get back.

You can still travel on your H1b or you can use your advance parole to travel , there is no proble what-so-ever in travelling , but Maama is right that you should have your advance parole approved and in your hand before leaving the country
so if you have to travel urgently , it will be prudent for you to travel on H1b , you can send in your AOS packet , YOU SHOULD NOT GO OUT OF THE COUNTRY ONLY IN THE CASE YOU DO NOT HAVE A VALID H1B STAMPED ON UR PASSPORT
