Petition transferred to new office

Our petition sat on a desk in Vermont for 265 days (our receipt day is November 14th, 2007). We got notice that it was transferred to California on August 6th, 2008. Anyone else had a similar experience? Any idea how long it might take now this it got transferred? Since California appears to be getting through the applications faster, I hope this is a good thing!

Hi Sunshine
I just got a copy of the actual Notice of Action to send our case from Vermont to California (I originally found out about the transfer online at the USCIS website), and the receipt date on the NOA is incorrect. Our receipt date is supposed to be November 14th, 2007 (which is the date it was received in the Dallas, TX office). However, then USCIS decided that everything should go to the Chicago office, so the Dallas office sent it to Chicago for us, and Chicago received it on January 23rd, 2008. On that receipt notice they honoured our original receipt date of November 14th, but on this new NOA, it says our receipt date is January 23rd. I have my lawyer looking into this to see if he can get it corrected. I would hate for this to be delayed AGAIN because of a stupid clerical error. I miss my husband. I hope nothing like this happens to you. Good Luck!

Hi Sunshine and deserving,

We just saw the same thing online with our case being transferred from VSC to CSC. Our receipt was back in January 2008 so I hope they honor the original receipt date.
Did you get a new receipt number when your case went from Texas to Chicago and Vermont?
Also, has your status online changed? Does it still say transferred? I wonder if they will mark it received when it gets to the new services center.
thanks,

to infinityiz:

Hi infinityiz

We never received a receipt number from the Texas office because they changed the rules of where the application had to be sent about a week or so after Texas got it, so they forwarded it directly to Chicago where we waited for another 2 months to get a receipt number. The Chicago office did honor the receipt date of November 14th that it arrived in Texas like they said they would. However, like I stated in my previous post, now Chicago has our receipt date as January 23rd on the notice that said our case was being transferred to California. How frustrating!

What's really sick, is this was the second petition we sent in. We sent in an I-130 application to the Chicago office in September of 2007, and it was rejected because we were told we sent it to the wrong office. So we lost 2 months with sending in a new petition to the Texas office. USCIS has still never returned the original one we sent in or the original money order. It's lost in their system somewhere now.

Anyway, we have not received a new receipt number from California yet, however I fully expect to because all our case status says now is the following... (see quote below). It now doesn't even say what office it was sent to. We received a letter in the mail telling us that our case was transferred, so I am hoping that they will also send a new receipt number and it will have specific information for the case being in California.

"Current Status: This case is now pending at the office to which it was transferred.

The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done, counting from when USCIS received it. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. To receive e-mail updates, follow the link below to register."

Anyway, I'll keep you posted when or if we receive a new receipt number!

Cheers!

Thank you for the congratulations, Rabeya83!

My husband is a citizen, so I'm not sure how long it will take in your situation, but I'm sure it won't take 5-6 years!!! Wow! That would be awful to be away from your spouse for that long!! I wish you both the best of luck, and if I hear or read anything that might pertain to your situation, I will pass it along to you.

Congratulations and thanks so much for your thorough answer! I'm so happy for you guys. I hope our case goes as smoothly now. We also had "issues" because we prepared the I-130 and I-485 together, but at the last minute when we read the instructions on the website we thought we had to send each application to a different lock box. So the cases got separated and it took us about 4 months to get a receipt number. Sigggghhhhh.

So did it take a few weeks for them to get to your case? Did you get several LUD's (changes to the last updated date)?

Well, I'm really glad your application went fast and I hope for the best. Good luck with the rest of your application.

Hi Infinityiz:

No, we never got any LUD's. The case was never touched from the time the Vermont office received in on January 23rd to the time it was sent to California office on August 4th. We were thinking maybe it got lost again. Fortunately, it didn't though! What I can't believe is that it it took less than a month to actually review our case once it was received in California! Bizarre! Honestly, what do they do in Vermont???

I just got a notice in the mail yesterday that our case has been transferred from Vermont to California. Did they change something? Back in August, I requested a transfer because Vermont was sooooo slow and was told that wasn't possible. So I requested it be expedited due to financial hardship and still haven't heard anything back from that, although I received a confirmation over the phone that a decision would be made within 2 weeks. The transfer letter was a real surprise! What's next to be expected? From what I'm reading Cal is taking a month to process the transfers???? Wow. How long should I expect before my husband is able to be with me?

Hi Nandi
After the California office finishes with your petition, it gets sent to the National Visa Center in New Hampshire. From there (at least for us), it has gone rather quickly. We had a case number form the NVC about 2 weeks after they received it from the California office. Then we filled out some more forms and sent them off to the NVC. Once again, about 2 - 3 weeks after they received the forms we heard back from them. Unfortunately, I was misinformed and didn't send in the originals of my birth certificate, and marriage certificate, so that delayed us a couple of weeks. However, we just received notice last week of my interview date which is December 1st! So, I am now scrambling to get my medical and all that stuff done before that date. Oh well... It's SO worth it to be with my husband in time for Christmas!!
Anyway, for us, between receiving approval and the interview date was 90 days. Good Luck Nandi! I hope it goes as quickly for you!

Well, checked for updates. My case has been sent to Atlanta for the interview process. I wanna yell "Yeah!" but don't know if it's appropriate. I read more and more posts that say my hubby won't be able to come with the approval of the I-130. Are we going about this the wrong way???? I really want to get him here as fast as possible, but especially by my birthday in February. Is that not going to happen? Can someone help?????

My girlfriend has an I130 petition filed in November 2005 by her sister. It was filed at the California service center. On March 19th they received an email that the case was transfered to the National Benefits Center. Can anyone tell me what this means?

iowaseabee: Petition filed for siblings take many years to be approved - because they are very low priority. Even if they were approved, no benefit could be conferred before the priority date goes current. The transfer is part of a broader restructuring of USCIS.

Lela29,

My sister and I also fill out a I-130 form in 2007. To days ago we receive an email notification from USCIS that our documents are going to be transfer from Vermont to NBC. My sister called USCIS to asking for more information and they told her that this action was done because they have and work overload and that the NBC will support the Vermont office to speed up the process time. In addition, I access the USCIS to check the process time for the NBC office and they don't have process time for I-130, they only have process time for I-90,I-102,I-131,I-539,I-765,I-817 and I-824; this could mean that this office has a small work load and that our application will be processed in the near future.

you can view the process time here: https://egov.uscis.gov/cris/processTimesDisplay....

I have applied for my son who is under 21. Now it was in the VSC. Yesterday I got an email stating that....

""Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: This case has been sent to another office for processing because it has jurisdiction over the case.

On January 7, 2010, we transferred this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to our NATIONAL BENEFITS CENTER location for processing because they now have jurisdiction over the case. We sent you a notice of this transfer.""

---------------> Is it good or Bad? What's gonna happen after this procedure?
ANYBODY CAN HELP PLEASE !! I will highly appreciate it.

Hi friends,

USCIS has asked for my birth certificate which I need to submit by 29th April 2010. My mother is a US citizen and applied for me under F3 category. Can anyone tell me what will be the next step after this document submission? How long it's going to take to get the visa? In the USCIS website, it's written that they ask for biometrics after the initial review but in my case they never did. Currently I'm in India and would be leaving for Toronto on 31st April 2010 as an immigrant to Canada. Please answer.

Regards
Joy
