Use this discussion forum if your I-130 has been approved and has been sent to NVC. You can also use this forum If you have any questions about your case at NVC, if you recieve any notice of action from NVC of which you don't understand, you can also use this forum if you have questions about CSPA or if your case is currently under review for applicability of the Child Status Protection Act (CSPA).

I just received this email from NVC. People with experience please what does it mean and please, when should I be expecting a notification of their action? Thanks

Dear Sir or Madam,

Your inquiry has been received at the National Visa Center (NVC).

This case is currently under review for applicability of the Child Status Protection Act (CSPA). You will be notified as soon as a decision is made. Please be advised that there is no timeframe for when this will happen. Please do not contact the U.S. Embassy or Consulate General, as they will have no further information.

You can also calculate your age yourself because CSPA language is very clear. You will need 1. your eligibilty category and the PD current date and 2. your I-130 received date and approval date. Use the two plus your birthdate, you will know exactly whether or not you are considered a child.

Thanks you Kansas1. I did calculate it using that method, I think my cspa age is 20, but my real age is 21. This is because my petition was filed 2004 and was approved 2005. My case became current Jan 2009. Do they really need alot of time to determine if someone is qualify, it took me just a minute to do the calculation. Kansas1 pls, what's next, do you know anyone who had thesame notification like this? Thanks

Yes, if NVC decides that you are a minor child under CSPA, they will send your DS230 too. Or if they calculate wrong and don't include you in the interview, you can write to the consulate then and the consul will make a final decision.

My brother, a US citizen who migrated to the US from the Dominican Republic, filed immigrant visa petition for me in December 1995. That's 13 years ago. I am still awaiting for an appointment at the US Consulate in Santo Domingo. When I turned in the initial I-130 I included my wife and my two minor children (14 and 16 years old, respectively). Upon being notified in 2007 by the NVC that I should complete again the I-130 and other required forms in addition to paying applicable processing fees, the NVC excluded my two children (who are now 27 and 29) who are single and live with the family.

Is there a way I could have my children included in my IV petition now? Under what act? I'm not sure if the retroactive child protection act applies in this case.

so the priority became current in Jan 2007, at which times your children were 25 and 27. Now, when was the I-130 approved? if it was approved after 1999, your younger child may be eligible 25-(1999-1995)=21.

Hey Kansas1, guess what. I got a reply from NVC today, the CSPA review after a month was finally completed. They wrote this:

This petition is now eligible for further processing. The petitioner, beneficiary, and/or attorney of record will receive further instructions regarding the processing of this petition.

Now I'm sure the CSPA covered me. What is next, Am I close to finishing my case at NVC and How many days does it take their letter to get to me.

My daughter has sponsored my husband and myself I 130. After the paperwork was transfered to Calif we were notified that we would get d 230s after the second fee was paid. Fee sent and forms completed. My daughter then had a letter from New Hampshire office asking for long birth and marriage certificates. As we had sent full certificates for both we were confused. She rang the office to be told that long certificates were required and the lady would not discuss this further. She also asked for police clearance for Germany and Ireland as my husband and I had lived in those places during his Military career 30 years ago. First we contacted the Ministry of defence who sent a letter which explained that as members of the forces we were under English law and gave us Military police clearance. They were amazed that the visa office did not know this and as we sent my husbands Army records and a full UK police clearance. Next we contacted the registrar of births and marriages to ask about these long certificates. They could not believe that the visa office had asked for long certificates. Since 1969 the format for certificates changed from landscape (wide) to portrait(long) However any one born or married before that date had the wide ones and they could not be changed. A certified copy can only be made from the original and as ours were wide that was all we could obtain. No one can change from wide to long. They also sent a letter to explain these facts. The two letters were sent over a month ago and we are still waiting for contact and hopefully an appointment at the Embassy..............Has anyone any idea how long we will wait that is presuming they accept these two letters. We have now waited for a year since my daughter first applied and a lawyer told us that it was usually 6 to 10 months for a parents I 130.

I am a green card holder since 2002, working overseas for 2+ yrs & in process of applying for citizenship. 6 months ago when I entered US, the immigration officer advised me to apply for re-entry permit. Anyone knows how long it would take from filing to getting finger print? and how to make the process faster? Any good immigration lawyer you can recommend? Thanks!

If you meet the continuous physical residency requirement, you don't need reentry permit and you will get citizenship soon, you can use American passport to travel after that. If you don't meet that requirement, your natualization will be denied and it is good advise to apply for a reentry permit to keep LPR. About one months to get FP for reentry permit.

This is a personal experience that I thought would be nice to let anyone know. My case may note be unique but I do believe my case is pretty rare. I'm still in the process of waiting, but up to now, everything seems to be going ok. So, here's my story:

My mom is the Petitioner living then in the state of Washington and I am the beneficiary living in the Philippines (but I'm not a Philippine citizen/national). Every calls that we made to the immigration was a conference call using Skype. I was the host from the Philippines, would call my mom first in the US then would call the immigration number. Fortunately the connections on every call was clear and never got cut off.

2001-February 12: My mom filed an I-130 petition for me. A Permanent Resident petitioning for an unmarried child over 21 years. Paid $110.
2001-March ?: Received NOA (Notice of Action) stating the immigration has received my mom's petition.
2002-August 22: Received a letter from the immigration stating that my mom's petition was denied due to abandonment. Apparently, sometime after March 2001 the immigration sent a RFE (Request for Evidence) that my mom never receive and because of not receiving anything, she never sent anything back to the immigration.

2002 September ?: My mom filed a MOTIC (Motion to Reopen Before the Commissioner) This is almost the same as filing another I-130 but still retain the PD (Priority Date) of the first petition. Paid another $110.

2002 September 20: Received NOA for the MOTIC.
2003 January 15: Received a letter from the Director of the Nebraska Service Center stating that he has approved the petition (however the petition still had to go thru the proper channels to have it officially approved).

2006 May 19: My mom filed an AR-11 (a change of address form notifying the immigration of the change) and moved to New Jersey.
2007 October ?: My mom became a Naturalized US Citizen (but have not yet notified USCIS).
2007 October 19: My mom made an InfoPass at the Newark, NJ Office to inquire about the petition. She was told she will receive a letter from that office.

2007 November 23: My mom received a letter from Newark, NJ Office stating that her petition is stored at the National Records Center (this is NOT the same as the National Visa Center) and to please wait for the records to be retrieved. We don't know what the NRC is or why the petition is there.

2008 December 5: My mom received a letter from Newark, NJ Office requesting her to file form I-824(Application for Action on an Approved Application or Petition). We were thinking that at least it's good news. We're thinking that the petition has been approved but not yet finalized.

2008 February 12: My mom filed the requested I-824. Paid the $340 fee (total of $560 for a simple petition).
2008 February 15: Received NOA for the I-824.
2008 July 6: I got married (but have not yet notified USCIS).
2009 March 03: Received Letter from Nebraska Service Center stating that the I-824 is Denied. WHAT!!! We were confused why the immigration would request us to fill out an application only for them to deny it. The letter also stated that the petition was 'Administratively closed on September 22, 2005'. This made us more confused cause we have no records of anything happening on 2005.

2009 March 24: Called the Immigration number to inquire. The 2 officers we spoke to were very nice. They mention that the petition is NOT denied (good news for us), but they could not give us the current status of the petition because it's not showing in their system. They recommended my mom to make another InfoPass at the Newark, NJ Office to inquire.

2009 March 26: My mom went on her InfoPass Appointment. The officer there told her to file another I-824 but also give a letter for a fee waiver (I'm thinking this is nuts if we have to pay another $340, and it might be denied again) and also attach the letter dated January 15, 2003.

2009 April 8: Before we can resend all the documents again. My parents got a letter from USCIS stating the the petition has been approved. WOW!!!??? So now we have an Approval Notice and no need to resend the I-824 and other documents.

2009 April 10: My parents was notified that the petition was sent to the Department of State NVC for visa processing. Now I know the visa will not be processed yet cause my PD is not yet current.

So, I originally started as F2B, went to F1, and down to F3. We still need to send in the documents of my mom's Naturalization Certificate and my marriage certificate. You can see that even though my case is not unique, I know this doesn't happen often. Normal petition process is simply filing, approval, waiting (years), PD becomes current, and then CP (Counselor Processing) that the US Embassy. However for me....the waiting years were the stressful ones. I do hope this doesn't happen to anyone else.

From you past posts, I thought you said that in 2005 your aunt didn't reply the RFE so the case status since 2006 is abandoned.
Do you have a I-797 notice of action AFTER 2005 saying otherwise? I know you do have an I-797 in 2002, but it doesn;t mean anything after what happened in 2005.
You can definitely use onlyone's method to have the case reopened and retain the 2002 PD.

2009 April 10: My parents was notified that the petition was sent to the Department of State NVC for visa processing. Now I know the visa will not be processed yet cause my PD is not yet current.

The PD was current if you were F1, that's why NVC sent you the letter and started the visa processing, but you are actually in F3 category now and PD is NOT current in this category. You or your mom has to let NVC know about the change in preference category, and hopefully you won't need another I-824 when the FB3 PD becomes current.

Yes, my PD is NOT yet current. I already sent my marriage certificate to my mom and I think she already sent that together with her Naturalization Certificate to NVC. So overall, I believe I went from F2B straight to F3. And ya, I hope we won't need to file another I-824. But I believe we won't need to cause the I-824 is only used to act upon an approved petition to a US Embassy or Consulate or to request a duplicate Approval Notice. And we already have the approval notice. At least this remaining part of waiting is just that........waiting. :).

In fact, I am new to this forum and was trying to present my questions /doubts in your forum regarding the NVC reply, Consular Processing and CSPA.

1-Applied for AOS on January 2007(EB-3, INDIA with PD April 30, 2001) and Received GC August2007.



2-Applied follow to join CP (Action on approved petition 1-824) for my three kids in India.



3-1-824 Approved on April 13th, 2009 from Nebraska Service Center.



I have contacted my local US consulate (Chennai, India) without waiting to hear from NVC and they requested me to submit notarized copies of my Permanent Resident card,140 approval, Passport copies etc along with kids birth certificates and DS-230 part 1 to begin the case. They immediately assigned me a case number via e-mail after receiving the requested documents.

Unfortunately, the visa bulletin shows now EB3 IN is as Unavailable.(ā€œUā€)

My husband is also with me here and his dependent AOS is pending with second interview scheduled at NY local office for tomorrow.

My eldest daughter is 23 now and her name is in approved 140 and 824.But she is aged out for two months as per CSPA (21+6 months + 140-approval time)



Now I have the following questions:



1-Do my kids have to wait again till the EB3 India category become current for the CP interview or they are eligible now on the basis of my green card and 1-824 approval? (I mean NVC will send a packet to the abroad consulate with visa number?-because during the approval time it was current)



2-Weather my 23-year-old daughter will get GC based on approval? ON THE OTHER HAND, who will decide the age out from NVC or the local consulate officer?



3-What about my husbands AOS approval and visa availability issue?

What is the timeline for processing once a case is sent to the NVC? Are we talking weeks, months or years before a visa would be issued? This is assuming all is well and no unusual circumstances are foreseen.
I am asking because I was about to submit an I129f for my fiancee but she was just notified that her case was sent from the National Benefits Center to the NVC. In March it was transferred from the California Center to the National Benefits center.
I guess my real question is will she be able to get here sooner with the current I130 processing or if I file the I129f?

Hi,

What are the chances of getting a visitor Visa once if a person cancels the immigration visa.
My parents visitor's visa recently was denied with the reason being that their immigration visa was pending(I-130). My parents DON'T want to immigarte to the US anyway. Their immigration visa (F4) was applied in Jan 1999 and now the prirority date is Aug 1998. So, we are in a dilemma whether to CANCEL their immigration visa and apply for visitor visa so that they can atleast come on a visitor's visa to the United States.

Would appreciate if someone can help us on this...

hi kansas, i would like to ask how long will it take for the NVC to process my visa if i have completed all the required documents that the NVC is asking... i am an IR2 category, my parents just paid for the visa processing fee, they have also completed filing the affidavit of support... i am now completing all the necessary documents here in the phils. i also have the cover sheet from the NVC, instruction packt data sheet from NVC which says i have to include them together with the DS 230 forms part 1 and 2 and all the required documents that i have to mail to the NVC. thank you very much in advance and i am looking forward to be enlightened here on your forum..

but the NVC do not mention nothing about the review of my case for CSPA . can someone explain this for me

If your PD is Nov 2000 and approved on Jan 2005, then ya, I believe that would make your daughter at 17 years old under CSPA. I am wondering if you, receiving the agent of choice form and your mom getting the affidavit of support bill, then it would mean that the review for CSPA is complete and your daughter is included. This is just a guess. Have you tried calling NVC to inquire?

The key is whether the consulate would treat them as if PD is no longer an issue or they would not do anything until your EB3 PD is current again. If the former, then there is no problem at all, and your 23 years-old has CSPA age under 21.

Your PD will become current in August 2009, so you and the petitioner may receive the NVC notice anytime from July to September.

You have to tell me what petition was approved? What category? PD current? I-824 needed or not?
If PD is current for your wife, and USCIS has notified NVC, you can expect NVC's first letter in a month or two.

I am confused. What I-130? You cannot file I-130 for a fiancee. You should file I-129F to get her to come to US with K1 visa and get married. After the marriage, she will file I-130/I-485 concurrently.

If this F3 I-130 was approved in 2005, it is quite safe for your 22 years-old to be classified as child under CSPA.

Did they come to US before? Or this B visa interview was their first? The chances of getting a visitor Visa is not necessarily better even if they cancels the immigration visa. They have to demonstrate strong ties and good social and financial status to the home country.



Hi,

What are the chances of getting a visitor Visa once if a person cancels the immigration visa.
My parents visitor's visa recently was denied with the reason being that their immigration visa was pending(I-130). My parents DON'T want to immigarte to the US anyway. Their immigration visa (F4) was applied in Jan 1999 and now the prirority date is Aug 1998. So, we are in a dilemma whether to CANCEL their immigration visa and apply for visitor visa so that they can atleast come on a visitor's visa to the United States.

Would appreciate if someone can help us on this...

You are about to finish the "applicant document" process (formerlly known as packet 3). Mail this back to NVC with the cover sheet (of payment receipt and barcodes) on top. Once NVC collects both applicant documents and petitioner's I-864, they will forward the packt to Manila and send you an interview notice. It will take a few months.


hi kansas, i would like to ask how long will it take for the NVC to process my visa if i have completed all the required documents that the NVC is asking... i am an IR2 category, my parents just paid for the visa processing fee, they have also completed filing the affidavit of support... i am now completing all the necessary documents here in the phils. i also have the cover sheet from the NVC, instruction packt data sheet from NVC which says i have to include them together with the DS 230 forms part 1 and 2 and all the required documents that i have to mail to the NVC. thank you very much in advance and i am looking forward to be enlightened here on your forum..

You (or the petitioner) only need to pay $70 one time, if you and all your F3 derivatives will be interviewed with you. Later NVC will send the Immigration Visa Fee bill for each and everyone NVC decided that can get visa based on this F3 I-130, at that time you will know for sure whether your daughter is given this IV bill.



i have posted the above tread but no one reply i will post this new tread hoping that some one will reply
i have received a choose of agent form from the NVC and my mother had received a affidavit of support bill for $70
but the NVC do not mention nothing about the review of my case for CSPA . can someone explain this for me

note the nvc sent a invoice number to pay the $70 i log on but i dont see my daughter who is 22 year old name

I 130 petition for FB4 category approved with PD of Oct 31 2005, but priority date is not current. Currently, on h1b in the US. Dont know if going through EB3 would be a little faster than FB4.

Please Look At my case info and help me out.

Petitioner: Father, USC in US.
Preference Category: IR2
Priority Date(Petition Filled): 25 NOV 2002
Petition Approved: 07 FEB 2007
Beneficiary Date of Birth: 19 MARCH 1988 (As At Now- 21 years 3 Month Older)
Beneficiary Status: Unmarried

NVC Requirements all completed on March 5, 2009.
Beneficiary Interview date on 7/21/09 in Ghana.(By then I would be 21yrs 4 Months)

The NVC is aware that I turned 21 on the 19th March 2009.

Question: What would happen on my interview date? Would the Local Embassy in Ghana consider my case under the CSPA or otherwise.

Seniors I need your help, please advise with your first hand experience.

if the petitioner is your biological father and he is a natualized US citizen, your age was frozen as a child already when he became a US citizen.

It is nice and relaxing to see you after a gap.
Today I called NVC to know about my kids follow to join approved case. (Approved on april 13,2009 from NSC with PD april 30,2001 for EB-3 India case) They said they mailed my attorney for visa fees to my two children out of three. (both in different dates last week)
But I have already alloted MDR # from Chennai consulate (India) for CP interview even though visa is U now.
question 1-When they will ask for the Affidevit of support ?
2-Do I have to wait to hear from NVC if the EB3 becomes current? (becoz I have the case # from consulate)

3-CSPA question: My eldest daughter was 21 years plus 5 months while our PD become current. (2007 January) and the 140 toof 5 months to approve (2005 january to june)
Do she is eligible for CSPA protection? and who will decide it? (from NVC or local consulate at the time of interview?

I found your expert opinions and services are great ,especially in this type of cases.
