Traveling on EAD/AP, No H1B. Any issues?

Has anyone experienced any issue traveling to India and coming back on AP? Couple of years back when I traveled, I was given a sort of warning from the immigration officer stating that "You're out of status in this country....What you're doing here.." . I did not really understand his comments since my I-485 was/is in a pending state and am on Adjustment of Status with EAD/AP. After 8 or 10 questions, he finally let me IN.

Anyone on similar status (EAD/AP, not maintaining H1B) can comment on their experience of overseas travel? Thanks!

That's probably an anomaly where the guy didn't know the rules. Not the first time. If you were out of status, why would he let you in. Some time new offers dont know everything but they cant let go off their ego.

Many of us have been traveling on EAD and have had no issues. I even returned 3 weeks ago. No questions asked in POE. Spent 5 mins in secondary inspection.

Was curious to know more about your experience. Which POE in US did you face this issue? Would be nice if you you elaborate what questions he asked you and how long till they let you in, this could help us be prepared in the future.

I have a question
I submitted renewal for my H1B that will expire on April/2018, can I travel now using the AP while my H1b application still pending? If I enter US using the AP shall the H1b still valid?

Hi,

I travelled using my AP while my H1B has been in extension process and I had no issues.

My experience using the AP at PortOfEntry - When you walk to the immigration officer you will show your AP and passport. Officer would verify passport and few other details and then take you to another big room where they verify AP. They take us to another room because the AP verifying process is bit longer and so we will be asked to sit and wait for maybe about 30 minutes and then they will call to the counter after they completed the verification, and ask few questions and allow. Usually this room is crowded because there are many people travelling with AP.

So If I use the AP to enter to USA, my H1b will be still valid? if any case my green card get denied, I still be ok?

you H1B will be still valid and you are still on H1B as long as you change it with your employer. I a in exact same situation as you...H1B expires May 2018 and i just came back from india (Nov 28th) taking a 45 days emergency travel on AP.
Do remember that the I94 will have the AP expiration date.

It was at Chicago. They (2-3 different officers) mostly asked me lot of questions about my work, why I visited India and so on. My total wait time was over an hour. When I came out, airline crew was waiting for me with my bags.

Hi 2002Green

The reply provided by "koutamsuresh" is what I also wanted to convey.
While entering I used AP and so the I94 changed to Parole. This did not affect my H1B.
Green card process will not get affected due to this.
Kindly ensure you have a valid EAD also.

I've traveled twice with my EAD/AP, in July 2017 and Jan 2018. I don't have any other valid status (used to be J-1). Both times I got sent to secondary inspection at the border, meaning an extra 1.5h at the border. Was eventually let through without any questions asked. I wonder if they even have the "PAROLED" stamp at the first inspection place.

I will be traveling on a valid AP /EAD which was applied by my spouse’s ex employer. He just recently changed his job. Will this change create any issues for my travel. My combo card is valid until Dec 2018. The renewals will be processed by new employer sometime later this year.

AP/EAD has nothing to do with the employer. its your own application and has no relation to where you work. You can switch jobs as much as you want. You are lucky that the employer is paying for ead/ap renewal. Just because they are paying for it, doesnt mean its their application.

My H1B expired on 31st Dec '17 and currently its in extension process. My EAD/AP was approved recently and its valid until end of this year. I also have an approved B1 visa which is valid until 2025. I understand, one can not travel through Europe without a valid US visa stamped on your passport or without a transit visa. So my question is:

As long as you have a valid US visa, you can use that for travel. It can be h1b or b1 or what ever it is. For entry into US, you can use AP. The person checking for visa at the check in counter or at transit cares only about the valid visa. They dont care what it is.

Recently travelled to India on EAD/AP and entered US last week, port of entry - Chicago(ORD).

Was taken to secondary inspection room to verify my status, was out in 10 minutes. No issues. This time immigration guys was nice.

Last time in 2014 was also smooth, but there was a racial comment by the immigration officer that Indians come to US and then conceive - kids were born here and make them US citizens. It was a provocation and I ignored it.
