Fee for Advance Parole for people who filed I-485 in 2008

Hi,

I filed I-485 during August'2008 along with advance parole. Now I need to renew Advance Parole which will expire in Sep'09. For the fee, when I looked at the instructions document for AP, it says that - "If you filed I-485, on or after July 30,2007, and you paid the I-485 application fee required, then no fee is required to file a request for advance parole".

I have paid fee of $1010 for I-485 during Aug'2008, so do I have to pay the fee for AP again since it is renewal & not the first time I am applying for AP ?

Does anyone in same situation, whether any one applied for renewal without fee ? is it applicable only when we apply for AP for first time ? Please let me

know about this.

if you paid $1010 for I-485, you get unlimited EAD and AP renewal, you dont need to pay fees for renewing both.

Thanks for the information. The instructions form (I-131instr.pdf) doesn't mention anything about unlimited renewal. Is it in any other instructions document ?
EAD instructions document do say that "If this is a renewal application and you are under C(9), you don't have to pay fees for EAD, however AP instructions document doesn't say that explicitly.

Yes, thats correct. If you paid $1010 you have paid your full dues. You do not need to send any payments for renewal of AP or EAD :)

I had recently (about 4 weeks ago) contacted my attorney as well as USCIS customer service for my ap renewal. And they both confirmed the same. If you send a cheque they might cash it, but you need not.

I read from a forum that below need to be submitted when renewing AP. Can anyone verify the completeness of this list?
1. A copy of approved form of identification which includes the applicant’s photo, name, and date of birth (driver license)
2. A copy of INS receipts of my I-485 and I-130,
3. Completed form I-131
4. Two color photographs
5. A copy of my passport (or redundant with #1?)
6. Copy of EAD (to show legal status as my nonimmigrant status was not renewed anymore after my 485 was filed)

AP can be filed up to 120 days before the Advance Parole (Form 1-512) expires. No need for filing fee if 2008 concurrent filing.

Am I missing anything?

If you are on H1B & have EAD (not using it) means u r have on kind of dual status (non-immi & AOS), I am in same situation. So I am little bit confused about it, whether to send EAD or last H1B approval notice. If anyone gone thru same situation, please let us know what should we use ?
