Hello All - I would be traveling on AP in 2 weeks time. and will be using it to come back along with copy of my I-485 and orginal EAD. I am not working on H1-B since almost a year now, but worked on EAD with my sponsor since 1 year, and I had used AP once when I traveled in 2008 and successfully entered via JFK, New York - POE.
My concern is presently since Jan 2010 I am NOT working for my sponsor (Company 'X') and working on 1099 as an independant consultant (NO vendors/3rd Party) using EAD with a company 'Y' who has also given me a letter stating that they will hire me fulltime down the road if they like my work and company performs well. I have to go to India due to my mom's operation and again return via JFK, NY - POE. What types of question can Immigration Officer ask? Will it be ok if I am not working presently and my I-485 is pending.
Also I understand if I was on H1-B I am bound to be employed and not be on bench even if I enter using Advance Parole. But since I don't work on H1-B since a long time and have only used my EAD for work since almost 1 year now, Do you think I will have a problem when using AP to come back?
Oh btw I am working in the same and similar field and profession as an independant contractor on 1099 as stated on my GC Labor Certificate.
Please share your experience if any and at your earliest convenience.

My case is similar to you. I came through Newyork in Jan 2009, NY and via Newark, NJ dec 2009. My new york experience was good but recently when I cam via newark; they asked me lot of questions.
But I do not think you need to worry, they may not ask you any question during secondary inspection or may pose few questions.
your current employer, job nature, who was GC sponserer. since your new job is in similar area you can tell them about AC21 (AMERICAN COMPETETIVE ACT OF 21ST CENTURY), mention completely as they may not understand AC21 (short form)
Keep your recent salary slips, 485 receipt.

One of my frnd landed yesterday in SF ( C.A) from bangalore on EAD
No question asked.
Just mere formality.
