Hi, I do not know where is the proper place to talk about this, but I have heard some rumors about rejections of EB2 applicants in USCIS interview. Officers told people that they have no new papers/citations since they filed I-140 and due to this they are not doing research so their 485 cannot be approved. I heard it has happened both for Nebraska and Texas cases. I am writing it here since in the 485 forum there does not seem to be a dedicated thread about EB2 interviews. Does anyone have more info on this?

In current situation NIW approval is taking about 9 to 10 months at NSC. Once it is approved, I-485 moves forward for interview. So my estimate is about 10 to 12 months after filing NIW people face interview. Here I'm talking about NSC folks only. In that time most of the applicants have at least poster presentation in conferences (worst case). If you haven't published any paper during that time but have submitted a manuscript, you can show that to the IO, even if it has your name somewhere in the middle. Furthermore, your PI can write a letter to the IO stating that you are preparing a manuscript or something that states that you are continuously involved in research. If you can't provide any of the stuffs that I mentioned, then probably you will be in trouble.

But again, the rumors that you have heard is mere fearmongering. I haven't heard anything like that in the forums or from people whom I know and who faced interview. Sometimes you need to filter the stuffs that you hear.

You have to be able to show that you're still in the field claimed on your I-140 - same as for I-485 RFE pertaining to the continuing engagement, which is a condition for I-485 approval. To my understanding that's all. If anyone has a different experience or info, please let us know.

Regarding the SR, this is my experience with SR for my case:

- I filed I-140 on 7/14/2017, and I asked Chen to raise a SR in mid of 2/2018 as it passed the normal processing time of Nebraska Service Center.
- Chen confirmed there is no harm on the application from raising the SR on 2/21/2018, but after 30 days we did not receive any response for SR.
- Chen sent another mail/email to follow up the initial SR on 3/21/2018.
- But when I checked my account (https://myaccount.uscis.dhs.gov/), it says that "On March 5, 2018, your inquiry about why your case is taking longer than our processing time, referral number SR10521xxxxxxxNSC, was completed', but still we did not receive any response for our initial SR.
- On 3/28/2018, I submitted a request for address change.
- On 3/29/2018, the case status on (https://myaccount.uscis.dhs.gov/) showed that my I-140 was approved on 3/29/2018
- On 4/2/2018, I received the approval letter in my mailbox.

I just received email confirmation that my i-140 got approved. Online status also changed to case was approved.

I got a lot of info here and thanks everyone. My PD is around August 16, 2017.

By the way, I prepared my petition by myself without kit and without help from anyone. I did some research how to write all the letters and petition and then filed by myself. It took me around 20 days to prepare everything. I did not receive any RF either.

USCIS website says their *estimated* processing time is 5.5-7.5 months. 95 days is like 3 months. I know one of my friends who filed in August and raised SR last week because he is out of the 7.5 months range. USCIS responded that he should hear back within 2 months!

The same thing has been happening a lot at TSC. The official processing time is 5 to 7 months. But a lot of cases from V Chen have been approved in less than 3 months. A few of their cases have been approved in less than 1 month. USCIS says cases are processed in the order received, but the evidence shows this is not true at all. It’s so unfair!

She didn't file with Chen though. However, she is surprised too. I filed a months and half before her and she was asking me questions about it when she put together her package. Now she is approved ahead of cases in July and August. Seems weird, and totally random.

If you turn email and text message to "yes" in the secret website, where you have your account and all the cases added on. Then you will get email and phone text message if there will be any activity on the case.

In my case I got email confirmation but no phone text.

My friend just received approval for EB1 too, at the same day for EB2-NIW. Her lawyer told her that it is not uncommon for USCIS to approve both cases at the same day, so they won't waste officers time with two cases. So that might be why she was approved for EB2-NIW as well in less than 100 days.

I think when you file I-1485, they start their process on it as long as your category is current. If the underlying I-140 gets denied, the 485 documentation done till the time is null and void. I applied eb1b in premium - concurrently - so sent 485/ead/ap and 140 all together. They approved the eb1b on 13th april, but the notice i received for my biometrics appointment is dated 6th april. So they already worked on my 485, even though i-140 wasn't approved. If you are from india/china and your 485 was submitted before march 31st, they will work on it as an independent submission. At some stage when they cross check your underlying 140, if they find its denied, they stop work on your case and you do not get a refund. That's my understanding.
