I filed end of Dec 17 and got my EAD by mid Jan 18, your case is also similar (concurrent), you should get it anytime now and within few weeks, please follow up with your attorneys to make sure no RFE raised.

Hey, just wanted to share that my I-140 got approved. Received an email notification and it shows as approved on USCIS website (https://myaccount.uscis.dhs.gov/). Funnily enough https://egov.uscis.gov/casestatus/myca... still shows as "my case was received".
PD was 05/18/17. Filed for a case inquiry on 04/23, got a reply 10 days later saying they had to do additional checks and that we would receive news in 60 days. Approval of I-140 on 04/17. Waiting for the letter.

After our employer raised a request, below response is received :
"Based on your inquiry, we have reviewed the status of your case and found that it remains under active examination. This office acknowledges the completion of your case being outside of normal processing time and realizes the inconvenience it may cause. The delay has been necessary in order to ensure thorough processing of your case. Unfortunately, we are unable to provide you with a definitive timeframe at this point. USCIS will notify you if further information is needed or when decision has been made."

How long our employer can wait for raising a request second time, incase if there is no action on the I140 application(Received date 5/15/2017)?.

Can we apply EB1 being on H1B ? if yes pls let me know what are the conditions. kindly help. Have 12 years of experience.

Yes we can. Criteria for EB1c is no different for H1 visa holders. Meet those criteria and you should be good.
