When to file LCA ?

Hello Friends,

I need some information.

My H1b is expiring by end of June 2018 and my company will extension by end of Dec 2017.

Question: I know H1B extension can be filled anytime during last 6 months of H1B expires. Does LCA filing process will be part of those 6 months or it can be filled now or anytime before 6 months ?

I want to initiate the process ASAP due to my wife dependency on H4-EAD and H4-EAD decision is expected by 31st Dec 2017. I want to make sure I submit my extension application before H4-EAD decision comes out.

LCA is pre-requisite to H1 filing, and takes a week or two approximately. So this 1-2 week period can happen right before the 6 month mark. Its just the H1 filing that can happen only as early as 6 months prior. If you file it 6 months prior you will have enough time to get your approval and file for EAD renewal.

The LCA cannot have a start date that is more than 183 days in the future. That means that the LCA can’t be even started more than 183 days before the H-1B start date.

hey. Just wanted to check with you when did you file your LCA? Was it 1-2 weeks before 6 months period started??
