Soft LUD on Denied I-140 and I290B

Hi all,

4 months back my i-140 denied due to 3 year education and we filled i-290B for denied i-140.in month i got update saying that


Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER

Current Status: This case is now pending at the office to which it was transferred.

But after 5 months i got a soft lud on my i-140 and i290b.

Please share a light if any body in same situaiton

Dont worry you will receive atleast three more LUD's in coming few days. This is normal I received 6 LUD's almost one every day ,It all depends on how their workflow is built ....

Just cross your fingers and wait

My case sent to aao on sept 2008 after that i got 4 luds as you mentioned.But once it moved to aao i don't think any body will get LUD untill a year i belive.


that is why i am very curious and crossing my fingers and praying the good .

yes its a weird..... my i140 was denied in january 2008 have applied 290B and case transferred to local uscis office since april 2008. no soft lud's after that.... curruntly AAO is taking atl least 18+ months for appeal so i dont expect anything till may be june 2009. mine was denied due to 3 year degree.

as per your response i thinking of another year and half .But this was surprise to me.

My employer filed Motion to Reopen/Reconsider for denied I-140 in November 2007. USCIS still has not taken decision on it. In my case I saw soft LUD last on 06/2008 but no change. I read on AILA website that it is taking about 18 months these days for I-140 appeals decisions. In my case USCIS denied because as per them they never received response to RFE but as per my employer they had fedex proof etc.

your case is in good shape and you will get the positive result ,dont worry ,dont loose the hope.In my case it was surprise to me that i got a soft lud.since it is i-140 we cannt find any more details,just we have to wait and pray the god

Soft LUD on both on May 3 2009 and message says:
"The I290B NOTICE OF APPEAL TO THE COMMISSIONER was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done, counting from when USCIS received it. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. To receive e-mail updates, follow the link below to register."

Anyone else any updates????

My case got updated on June3,2009 and message is like this"Appeal/Motion/Certification sent to Administrative Appeals Office for review".
Yesterday it got updated with message "This case is now pending at the office to which it was transferred"
Is this mean some decision made at AAO?
You got already message like this on May 3 2009!after that you have goy any update from your attorney/employer?

However what I did was, browsed through AAO cases that have been made public. The public cases have personal info blacked out but the SRC number is available.

Here is what I found: If we get the message that the AAO has now transfered it back to uscis and it will be processed in the order in which it was ........
then the case in the AAO sheet says that it has been approved.

BUT

If the message says something like "On April 15, 2009, the Administrative Appeals Office returned this case. If your case was remanded or your appeal was sustained, we will notify you of our action within 60 days of the date of the AAO decision. If you move while this case is pending, call customer service."

Then it has been denied for guarantee. All AAO cases that have been denied has the message above, with exception to just 3 cases out of a 100 that I checked. If you want, let me know the last 4 digits of your case number and if I come across your case, I can give you the link to your case doc ID. Also let me know if it is a SRC or whatever... Wouldnt know it right now but will take time.

Which means that the USCIS does read what the response and puts up a vague answer on the CRIS.

i have this status sitting on my online case status for my i140 and 290B since 4.6.2008....and i haven't heard received anything after that....NO lud what so ever... does it mean my appeal is approved and they are just waiting to pass the standard 18+ month period ?.. :) however my i485 is still pending and never denied so yeah u might be right....in fact i received RFE on my i485 in march 2009 asking to provide all my i94s starting from the date of i485 filling... (june 2007)....

5769 are last 4 digit for my case....see if u can see something for me.....thanx...in advance....

statistically, from what I have analyzed, your case might have been approved, which is where I will keep an eye for your last 4 digits. Yes... We all may have to wait a painful 18 months. However if we come across the case papers, we can have an early unofficial answer (will not have any immigration use, but will have some peace of mind)

BTW: is it a SRC or LIN or?????

Though i alreday have new i140 approved with same employer .. I m triyng to keep my old priority dates..



And yeah IT's a fun game to wait and watch 18+ months.. Lots of people with their own answers and confusions... Lol

I-140 and I-290B have different numbers.
The updates are on I-290b only.No staus change on I-140.It still has the old messgae"Case received and pending"
Mine applied center is SRC

They will be two different numbers. Effectively from what I understand, the I-140 number is what will resume for the rest of the GC process. I-290's SRC number is as long as the AAO is in progress.

This update of "Case transferred "could also mean..sent to AAO"..because it does not say 'Back to USCIS service center". Instead, it says just "transferred to USCIS office" and this can be AAO at DC. Still hoping I am wrong and you are right!

If it says case transfered to AAO then it simply means that USCIS has sent the case to AAO (which IS in DC - clarified by my attorney). If it says "transfered to USCIS office" what really makes the difference is what is said after that.... transfered and what?... If you scroll above and see one of the messages on July 3 2009 (I think) I have posted my findings there. The message corellation was quite accurate but not guaranteed through.
