My PD is EB3I June 2008, can i file 485 if DATES FOR FILING OF EMPLOYMENT-BASED VISA APPLICATIONS equals or higher than my PD?

to apt1706:

Every months USCIS releases a bulletin which indicates if they are accepting Final action dates or Filing dates. watch the bulletin for each month - they have not accepted filing dates since Dec 2016. So even if filing dates pass your PD you cant file for I485, until USCIS accepts filing dates. You can file if Final action dates pass your PD.

User "Spectator"'s posts have been dispassionate and analytical. Not sure if he is an immigration lawyer. His recent post seems to suggest a lot of uncertainity and significant delay to process applications due to interviews.

USCIS started clearing December 2006 EB3 I cases.
As per new PI, 2007 EB3 I has only 1700 pending cases.

It means USCIS has only 1700 EB3 I cases to process in next 6 months.
Is there any chance that USCIS accept FD in April VB? or do they move EB3 I FAD to Dec 2007 in next couple of months?

Below are numbers from pending Inventory. Dates has been in 2008 since such a long time. How come all of a sudden so many EB2 with PD of 2008 filed in April 2017 and what is the reason people with PD of 2009 went down and significantly went down for people with PD of 2010 almost by 70%.

Looking at 2008 below inventory ... 2009 will not be current for next 3-4 years for sure.

Hi Aceman

Quick question for you, please help

On the 1st page of PI I-485 as of Jan 2018 under the

EB-3 category for the year 2008 we have the below data :

Jan - 8
Feb - 10
Mar - 10
April - 3
May - 12
June - 6
July - 8
Aug - 9
Sept - 1
Oct - 16
Nov - 4
Dec - 9
Total - 96

Does the above mean that the candidates having PD in the year 2008 who are waiting to get GC are only 96 this # includes all candidates from all countries ( ROW ), India, China, Mexico, Phil who are all waiting for green card ?

Follow up question

Since we don't have data beyond Aug 2017 for India EB - 3 category and also no data for people applying for counselor processing, what do you see the movement like for EB-3 for those having PD in the year 2008 ?

Thanks in adavance

That 96 does not include India, as EB3I was never current beyond July 2007

In Jan Inventory it's still showing lot of Pending Numbers in 2008 (pretty much close to 8K).. Are these all porters from Eb3 I to EB2 I??
If that is the case then EB3 I will move Close to EB2 India by End of FY 2018 Quota ..
When do you think we can hit end of 2009 for Eb2 I??

to RaghuR:

As per the new Inventory December 2008 has 1323 people. Hence there may be one week movement only. The prediction will be 22nd December/24 December 2008. As CO had predicted earlier that there might be 1 week movement. There could be lot of porters from EB3 to EB2 that's why its piling up that leading to only one week movement.

Guys,

I am not that good in analyzing pending inventory.
Any guess on when will I able to file my 485.
My case in under EB3 PD is Jan 25th 2008.

Appreciate your guess...

to eb3may2007:

He made it clear in the Jan check in. There is no visibility for EB3-I beyond July, expect 1 to 3 month movements for Apr-Jun bulletins. Based on the latest 485 inventory, EB3-I best case would be a final action date of August 2007 in the June bulletin.

EB2/I will hold steady in the Dec 2008/Jan 2009 date range for these 3 months.

The real fun starts in July - If the interview requirements are creating a log jam (expected this fiscal year as the new interviews are still be scheduled out and the agency is still reacting to this new initiative), expect a "small windfall" for EB2/I (courtesy EB3).

I don't see EB1-I gaining from this spillover this year as they will be also dealing with the interview delays (applicants after 03/2017).

Watch for RFEs in the EB2-I category in the summer months for predicting any possible movements in the last quarter of the fiscal year.
